Of "Food Establishment" - 03/21/1983AMENDS Ord. 8018 DGV:da ORDINANCE NO. 8427 ------ AN ORDINANCE AMENDING SECTION 12-16 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, PERTAINING TO FOOD AND FOOD ESTABLISHMENTS, BY ADDING THERETO A DEFINITION OF "FOOD ESTABLISHMENT"; PROVIDING FOR A SAVINGS CLAUSE AND PRO- VIDING FOR PUBLICATION. WHEREAS, there are 111any charitable and non-profit organizations within the City of Lubbock desiring to raise funds by food sales of various types; and WHEREAS, such food items are usually prepared in individual homes; and WHEREAS, it is not practicable to inspect the home kitchens where such food items are prepared; and WHEREAS, the City Council deems it to be in the public interest to allow sales of home-prepared food items by non-profit and charitable organizations within the City of Lubbock; NOW THEREFORE: • BE IT ORDAINED BY THE CI.TY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 12-16 of the Code of Ordinances of the City of , Lubbock BE and is hereby amended by adding thereto the following definition: Food Establishment shall mean those commercial establishments defined as "food processing establishments" or "food service establishments" by the Rules on Food Service Sanitation adopted by the Texas Board of Health and such definitions shall not be deemed to include kitchens in private homes preparing non-potentially hazardous food items for sale as fund raising items by charitable and non-profit organizations on a temporary basis, nor shall such terms include the site at which such sales for charitable purposes take place. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alterna- • tive method prov;i,ded by law.
