HomeMy WebLinkAboutOrdinance - 8412-1983 - Amnd Zoning Ord. #7084 And Lubbock Map Changes For Zone Case #1001-D - 03/10/1983SMH/mck ORDINANCE NO. 8412 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 1001-D; CHANGE TRACT B, RANCHLAND TERRACE ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNT?, TEXAS, FROM C-2A TO A-1 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVID- ING FOR A PENALT? AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which t:1.Jne persons appeared in support of the proposal; and, aftel' said hearing, it was by the City.Council determined that it would be in the public interest, due to changed conditions, .that the Zoning Ordinance and the Zoning 'Map be amended .in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1001-D SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change Tract B, Ranchland Terrace Addition to the City of Lubbock, Lubbock County, Texas from C-2A to A-1 Zoning District, located at 40th Street and Chicago Avenue and subject to conditions. SUBJECT TO THE FOLLOWING CONDITION: a. That the Planning and Zoning Commission and'.sthe City Council approve the site plan with elevation prior to the building permit being issued. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. . ' . SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. BERTRAM HENRY BROWN WINES BROWN McALISTER: BROWN HENRY BERTRAM HENRY McALISTER: BROWN The site plan usually Is the location; at the point of Issuance of the building permit they have to submit an elevation •••• I don't see any problems with the site plan; It appears to me that It might ought to Include an an idea of an elevation. Maybe we better ask Mr. Wines -Is he going to build some more apartments I Ike he did? Is this an extension of what you have been doing (to Mr. Wines)? (Inaudible) I think the citizens out there are concerned about the kind of apartments you build In that area, and I think Council Is too. I think we need to know what your plans are. I don't know any other way to say it, but -maybe we need to know what you plan to do. Of course, the site plan would show that with the elevation. Not many are very proud of It, and the City Isn't either. We could attach the elevation to the site plan approved by the P&Z, could we not? With that condition on It. OK Any further questions of Jim? If not, the hearing Is closed. Is there a motion? I think I wl I I move we approve the zone change-- that really Is not the lssue--other concerns there are, subject to, as Indicated here, the approval of the site plan that would Include an elevation/description of the structures to be built before the building permit Is Issued. Motion seconded by Baker; 5/0 • Jim, after listening to the tape, I agree that it would be best to put this matter on the agenda for March 10 for second and final reading, and If It ts the Council's Intent to approve the site plan and elevation before approval of this ordinance on second andfinal reading, they may reflect their Intent at this time. Therefore, the Minutes would reflect no action on this matter until Mr. Wines complies with the conditions stated above. That is to say, the ordinance wil I be "held" until further notice from your department. Councl Iman Brown clearly states that he has no objection to the zone change, and In the protective Interest of the City, we need to at least put this on the March 10 agenda for further action by the Counc i I • I think the ordinance needs to reflect the condition as stated above in the motion, don 1t you. Cunningham, City Manager· February 24, 1983 SUBJECT: Second Reading Ordinance of Zone Case #1001-D (Weldon Wines) .... : At lunch today City Council discussed informally Weldon Wines' zone case and the approval of the site plan with elevation and the description of the building. Mr. Brown indicated that he had intended for City Council and Planning and Zoning Commission both to review the site plan, including elevation and description of the building, prior to a building permit being issued; however, there is probably some confusion and it probably has been written up that it will be just P & Z. At lunch we also discussed several alternatives as to how we could make sure that this goes before both P & Z and City_Council prior to issuance of a building permit. One way, of course, would be to just hold second reading until such time that that occurs. Another way would be to amend the ordinance on second reading. I would like for the two of you to get together and discuss this and see if there is a preference as to how we should handle this and if it is the desire to do.a second reading ordinance amendment, please have it prepared for the next meeting. I do believe that it is the Council's intent, though., that they review the site plan, as well as P & Z. I had intended to have Mr. Brown clarify that when we had the annexation hearing, but I forgot. · I will appreciate your review of this and any suggestions as to how to further handle it.
