HomeMy WebLinkAboutOrdinance - 8403-1983 - Amnd Ord. #7084 For Change: Zone Case @2386; Change N. 5 Feet Of Lot 18 - 01/29/1983SMH./mck ORDINANCE NO. 8403 AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BEING THE ZONING CODE, SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2386; CHANGE THE NORTH 8 FEET OF LOT 18 AND ALL OF LOTS 19 AND 20, IN THE ORIGINAL TOWN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM C-4 TO C-4 (DH) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVID ING FOR PUBLICATION. WHEREAS, the Carlock Building, 1001-1009 13th Street was built in 1930 as the New Cotton Exchange Building, and WHEREAS, the building provided expanded facilities for cotton related industries and is symbolic of the continuing role of cotton as a dominant factor in Lubbock's economy, and WHEREAS, Carlock and Company, under the leadership of the late C.P. and Herbert Carlock and of Watson Carlock, has been officed in the building since 1930, and WHEREAS, the Carlock Building is one of the least altered early office buildings in downtown Lubbock and one of the few buildings in Lubbock built in Art Deco style, and WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed change in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changetl conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ti . , ZONE CASE NO. 2386 SECTION 1. THAT the-North 8 feet of Lot 18 and all of Lots 19 and 20 in the Original Town Addition to the City of Lubbock, Lubbock County, Texas, BE and is hereby changed from C-4 to C-4 (DH) zoning district, and declared to be a historic landmark district. SECTION 2. THAT the principal building located thereon BE and is hereby declared a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic land- mark structure therein, in terms of style, color, materials, texture, and basic form as found in the following styles: Modern, as described in the booklet, "Architecture in Lubbock: A Guide for Identification and Preservation", First Edition, 1979, and Art Deco, as described in John J. G. Blumenson, Identifying American Architecture. SECTION 4. THAT the following BE and are hereby declared to be exterio architectural features, and as such shall be preserved in their present form: 1. exterior brick walls and decorative brick detailing 2. gray Texas granite bases on each pilaster 3. multi-colored art glass windows above each glass panel on the east and north facades 4. ornamental stone string course between first and second stories 5. stone panels, parapet and pilaster caps 6. all present first and second floor glazed areas 7. all windows on first a.tJ.d second floor shall be divided to suggest the original construction method. SECTION 5. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shall be used to indicate the degree of alteration which has already occurred and the degree of preservation of the original structure. These photographs shall be further identified as follows: 1. East facade 2. North facade 3. West facade 4. East and North facades, angle view 5. Typical storefront bay showing glazing division 6. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
