To Quarantine Of Animals For Rabies Observation - 07/28/1983DGV:da ' ORDINANCE NO • 7083-A AN ORDINANCE AMENDING SEC. 4-30 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO QUARANTINE OF ANIMALS FOR RABIES OBSERVATION; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, Section 4-30 of the Code of Ordinances of the City of Lubbock, Texas, provides that following the final day of rabies observation, animals not infected must be held a minimum of fifteen (15) days; and WHEREAS, Sec. 3.04(f) of Vernon's Ann.Civ.St., art. 4477-6a, the Rabies Control Act of 1981, requires that such animal be held a minimum of three (3) days; and WHEREAS, it is deemed in the best interest of the citizens of the City of Lubbock to conform Sec. 4-30 of the Code of Ordinances to the requirements of the Rabies Control Act of 1981; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 4-30 of the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended to read as follows: Sec. 4-30. Disposition of animal not redeemed by owner or custodian. The City of Lubbock animal control supervisor may sell and retain the proceeds or keep, grant, or destroy an animal that the owner or custodian does not take possession of on or before the third day fol- lowing the final day of quarantine. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alter- native method provided by law.
