Ch 31 Reg Operation Of Limousines And Touring Vehicles In Lubbock - 10/14/1982OOV/mck ORDINANCE NO. 8374 AN ORDINANCE AMENDING CHAPTER 31 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE OPERATION OF Lnt:OUSINES AND TOURING VEHICLES WITHIN THE CITY OF LUBBOCK; PROVIDING FOR K SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to have available high quality limousine service within the City; and WHEREAS, the present ordinance regulating such vehicles does not provide for limousines to be more than five (5) years old; and WHEREAS, automobile manufacturers are continuing to "down-size" their automobiles to such an extent that the City Council believes that the ordinance may be met with vehicles more than five (5) years old; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 31 of the Code of Ordinances of the City of Lubbock, Texas, be and is hereby amended by amending the language of the following sections to read as follows: Sec. 31-1. Definitions. Limousine. The term "limousine" shall mean any unmetered late model luxury vehicle with a seating capacity for a minimum of four (4) passengers or an antique vehicle which has a seating capacity for a minimum of three (3) passengers and which vehicles are used for the transportation of passengers for hire to and from the Lubbock Interna- tional Airport or any such vehicle exclusively chartered for a minimum of one hour carrying such charter passenger or passengers to and from desig- nated points within the City. For purposes of this chapter, a "late model luxury vehicle" shall be a full size model of a commonly recognized manu'"' facturer of luxury automobiles, including, but not limited to, such manufactureres as Cadillac, Lincoln, Mercedes and Rolls Royce, which vehicle shall not be more than ten (10) years old, unless special permis- sion for the use of such vehicle is granted by the City Council. The term "antique vehicle" shall be any vehicle approved by the City Council which is at least forty (40) years old. The term "limousine" shall not include vehicles rented without drivers, taxicabs, touring vehicles, publicly franchised buses or vehicles owned and operated by motels, hotels and other businesses for the transporting of their guests or employees free of charge. Sec. 31-59(a)(2). (2) The number, kind, age and type of equipment and the color scheme to be used by the applicant. Sec. 31-59 (b). (b) The City Manager shall, after the City Council has determined the public convenience and necessity for such service, issue a limousine or touring vehicle business permit to such applicant upon compliance with the requirements of this chapter and shall issue permits for the operation of all vehicles complying with the requirements of this chapter and any special requirements imposed by the City Council. No.permit will be 1 issued unless every vehicle proposed to be used complies with the followingj minimum requirements: Sec. 31-60. Replacement of vehicles in service. A permitted limousine may be removed from service and replaced with another vehicle so long as the total number of permitted limousines does not exceed the maximum number permitted for the business by the City Council. The replacement vehicle must meet all requirements of this chapter, however, and, if more than ten (10) years old, must be specially approved for use by the City Council. SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
