ORDINANCE NO. 83.60
AN ORDINANCE AMENDING CHAPTER 12 OF THE CODE OF ORDINANCES, CITY OF LUB-
BOCK, TEXAS, ENTITLED FIRE PROTECTION, BY ADDING SECTIONS 12-3, 12-4 AND 12-11,
PROVIDING THAT SMOKING IN BED IN A HOTEL OR MOTEL ROOM SHALL BE PROHIBITED AND
PROVIDING A REQUIREMENT THAT THE OPERATOR OF PREMISES HOUSING A HOTEL OR MOTEL
SHALL POST.AND MAINTAIN A WARNING SIGN BEARING THE PROHIBITION OF SMOKING IN BE
IN A HOTEL OR MOTEL ROOM AND PROVIDING THAT VIOLATION OF ANY PROVISION OF THIS
ARTICLE SHALL BE DEEMED A MISDEMEANOR; PROVIDING A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock has determined that the
changes indicated below would be in the best interest of the citizens of Lubboc
for their fire safety and prevention of substantial loss of life in hotel and
motel fires in the City of Lubbock, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Chapter 12 of the Code of Ordinances for the City of
Lubbock entitled "Fire Protection" BE amended by adding the following sections
to read as follows:
"12-3. Smoking in Bed --Prohibited. No person may smoke in or on a bed
located in a hotel or motel room located within the City of Lubbock."
"12-4. Warning Signs. The operator of premises housing a Hotel or Motel
shall provide, post and maintain warning signs in each dwelling unit which
bear the prohibition of Section 12-3 of this Article in its entirety and
which states "ANY PERSON WHO SMOKES IN BED IN A HOTEL OR MOTEL ROOM IS
SUBJECT TO A FINE OF UP TO $200.00. City of Lubbock Ordinance No.
"12-11. Violation --Penalty. The violation of any provision of this
Article shall be deemed a misdemeanor punishable by a fine not to exceed
$200.00."
SECTION 2. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT violation of any provision of this article shall be
deemed a misdemeanor punishable by a fine not to exceed $200.00.
SECTION 4. THAT the City Secretary is hereby authorized to cause

method provided by law.
