'j AN ORDINANCE AMENDING SEC. 15-3 OF THE CODE OF ORDINANCES OF THE CITY OF ~~LUBBOCK, TEXAS, TO PROVIDE FOR ADDITIONAL EX OFFICIO MEMBERS OF THE LUBBOCK ·. IIBOARD OF HEALTH COMPOSING AN ANIMAL SHELTER ADVISORY SUBCOMMITTEE; AND PROVIDING '
lA SAVINGS CLAUSE. ~~ WHEREAS, Senate Bill 291, to be known as Vernon's Ann.Civ.St., Art. 4477-
l6b, enacted by the 67th Texas Legislature, requires the governing body of every
]city of more than 75,000 population to appoint an animal shelter advisory
committee composed of four members; and
WHEREAS, such animal shelter advisory committee is to assist the City of
!Lubbock in complying with the requirements of the above cited statute; and
WHEREAS, the City of Lubbock already has in existence a City Board of
Health with expertise in such matters; and
WHEREAS, the City Council of the City of Lubbock deems it to be in the best.
interest of the citizens of the City of Lubbock to have said animal shelter
advisory committee function as a subcommittee of the City Health Board; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Code of Ordinances of the City of Lubbock, Texas,
be and is hereby amended by amending the language of Section 15-3 to read as
follows:
Sec. 15-3. Ex officio members and animal shelter advisory subcommittee.
A. The city manager and the director of the city health unit shall be ex
officio members of the board of health, without voting privileges, and
shall act in an advisory capacity to the board. In addition, there is
hereby created an animal shelter advisory subcommittee of the board of
health, which committee shall be composed of ex officio members of the
board of health unless the board of health shall contain a member with the
required qualifications. The subcommittee shall be composed of persons
with the following qualifications: a licensed veterinarian, two animal
welfare organization representatives; a City official and a City animal
shelter employee. Persons appointed to such positions by the City Council
shall serve indefinitely so long as they do not fail to attend more than
three meetings of the subcommittee in succession. In that event, or in
the event of a resignation from the subcommittee, the City Council shall
name a successor from the same representative group.
B. The subcommittee shall meet at least three times each year and shall
perform the following duties:
(1) In an advisory capacity assist the City of Lubbock in complying
with the terms of Art. 4477-6a, V.A.c.s.
(2) In an advisory capacity assist the City in establishing proce-
dures applicable to the City's animal control program as follows:

(a) Procedures to insure that the City's animal shelter shall
separate all animals in its custody at all times by species, by
sex (if known) and if the animals are not related to one another
by size.
(b) Procedures to insure that the City's animal shelter will no
confine healthy animals with sick~ injured or diseased animals.
(c) Procedures to insure that the City at least once a year
employs a veterinarian to inspect the City's animal control
shelter to determine that such facility complies with the re-
quirements of Art. 4477-6b~ V.A.C.S.
(d) Procedure to insure that the City maintains the necessary
records required under Art. 4477-6b, §2(e).
C. Members of the subcommittee, unless they are also members of the board
of health~ shall not have voting privileges on the board of health, and
shall act in an advisory capacity only.
SECTION 2. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason~ the
remainder of this Ordinance shall not be affected thereby.
