ORDINANCE NO. 8354
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2305-B;
TO CHANGE A TRACT OF LAND OUT OF SECTION 22, BLOCK A, CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS FROM AM SPECIFIC USE TO A-1 AND AMEND CONDITIONS OF ORDINANCE NO.
8308; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION
1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the City
Council finds that due to changed conditions, it would be expedient and in the
interest of the public health, morals, and general welfare to make those
proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 26 of Ordinance No. 7084, as well as
notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended
in 1961, and notice was duly published in the Lubbock Morning Avalanche-
Journal more than fifteen (15) days prior to the date of the public hearing
before the City Council on such proposed amendment, and the public hearing
according to said notice was duly held in the City Council Room on the second
floor of the City Hall, Lubbock, Texas, at which time persons appeared-in
support of the proposal; and, after said hearing, it was by the City Council
determined that it would be in the public interest, due to changed conditions,
that the Zoning Ordinance and the Zoning Map be amended in the manner here-
inafter set forth in the body of this Ordinance and this Ordinance having been
introduced prior to first reading hereof; NOW THEREFORE: I
i BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:

SECTION 1. THAT:Ordinance No. 7084 and the Official Zoning Map Be and
the same are hereby amended as follows, to-wit:

of Ordinance No. 83.8, (located at 2nd Street and-Utica Avenue), subject
to conditions and being more particularly described as follows:

METES AND BOUNDS DESCRIPTION of a tract of land and that portion of a 20 feet
alley, to be closed, located in Section 22, Block A, Lubbock County, Texas,
being further described as follows:

BEGINNING at a point which bears North a distance of 770.00 feet and East
a distance of 2027.90 feet from the Southwest corner of Section 22, Block
A, Lubbock County, Texas;
THENCE West a distance of 158.00 feet;
THENCE North a distance of 105.00 feet to a point of curvature;
THENCE Northeasterly around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00
feet, and a chord distance of 21.21 feet;
THENCE East a distance of 133.00 feet;
THENCE South a distance of 110.00 feet;
THENCE South 45° East a distance of 14.14 feet to the Point of Beginning.
CONTAINS: 17,761.72 square feet.
SUBJECT TO THE FOLLOWING CONDITION:
a. That it be tied to site plan as presented.
SECTION 2. THAT violation of any provisions of this Ordinance shall be
deemed a misdemeanor punishable by a fine not to exceed two.hundred dollars as
provided in Section 1-5 of the City Code.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared uncbnstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
