Zoning Ord. #7084 And Lubbock Map Changes: 2375. - 08/26/1982t . ..,. • SMH:j s ORDINANCE NO. 8352 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2375; CHANGE A TRACT OF LAND OUT OF SECTION 3, BLOCK O, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-3 TO M-2 ZONING DISTRICT; SUBJECT TO CONDITIONS; PRO- VIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which .was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes ·in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said )notice was duly held in the City Council Room on the second floor of the City ,.!Hall, Lubbock, Texas, at which time persons appeared in support of the propo- !:sal; and, after said hearing, it was by the City Council determined that it !jwould be in the public interest, due to changed conditions, that the Zoning I! Ordinance and the Zoning Map be amended in the manner hereinafter set forth in ,:the body of this Ordinance and this Ordinance having been introduced prior to dfirst reading hereof; NOW THEREFORE: q ., liBE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ll I I ! ZONE CASE NO. 2375 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map Be and the same are hereby amended as follows, to-wit: TRACT I A tract of land out of the Southeast One-Fourth (SE/4) of Section 3, Block 0, Lubbock County, Texas, being the West part of that ,certain tract de- scribed as· Tract 2 in the deed from Lillie Dickinson to William A. Hensley dated November 7, 1958 and recorded in Vol. 717, Page 333, Deed Records of Lubbock County, Texas, and being described by metes and bounds as follows: BEGINNING at a ~" square metal tube set at the intersection of the South line of a Street Dedication and the West line of an Alley Dedication (both described in Vol. 476, Page 531, of the Deed Records) for the Northeast corner of this tract, from which a 3/411 iron pipe found at the Northwest corner of Lot 1, Townsend and Strong Addition bears N. 00°08'50" W., 30.0 feet and N. 88°03'4011 E., 317.51 feet; II 1 ~ ji jl THENCE S. 00°08'50" E., along the West line of said alley9 289.14 feet to an "x" cut in top of concrete curb of alley pavement stubout and in the North line of East 13th Street for the Southeast corner of this tract; THENCE W., along the North line of East 13th Street, 164.78 feet to a~~~ square metal tube set in the Westerly line of Magnolia Avenue for the Southwest corner of this tract; THENCE N. 05°49'10" E. 147.98 feet to a large spike nail set in wooden top of storm cellar for a Westerly corner of this tract; THENCE N. 28°54'40" E. 159.33 feet to a ~~~ square metal tube set at the Southwest corner of said Street Dedication for the Northwest corner of this tract, from which a 3/4" iron pipe found set in the Southerly right- of-way line of East Broadway bears N. 28°54'40" E. 34.94 feet; THENCE N. 88°03'40" E., along the South line of Street Dedication, 72.05 feet to the Place of Beginning. TRACT II A tract of land out of the Southeast One-Fourth (SE/4) of Section 3, Block 0, Lubbock County, Texas, being the East part of that certain tract de- scribed as Tract 2, in deed from Lillie Dickinson to William A. Hensley dated November 7, 1958 and recorded in Vol. 717 9 Page 333 of the Deed Records of Lubbock County, Texas, and being described by metes and bounds as follows: BEGINNING at a ~~~ square metal tube set at the Southeast corner of a: Street Dedication (recorded in Vol. 476, Page 531 of the Deed Records) for the Northeast corner of this tract9 from which a 5/8" iron rod found set in the Southerly right-of-way line of East Broadway bears N. 00°08'50" W. 30.0 feet and from which the Northwest corner of Lot 1, Townsend & Strong Addition bears N. 00°08'5011 W. at 30.0 feet and N. 88°03'40" E. 133.9 feet; THENCE s. 00°08'50" E. at 270.36 feet pass a 3/4" iron pipe found in place, in all 295.36 feet to a ~" square metal tube set in the North line of East 13th Street for the Southeast corner of this tract; THENCE W., along the North line of East 13th Street 9 168.52 feet to an "x" cut in concrete gutter of alley pavement turnout for the Southeast corner of an Alley Dedication (recorded in Vol. 476, Page 531 9 of the Deed Re- cords) and for the Southwest corner of this tract; THENCE N. 00°08 1 50n W. along the East line of said Alley, 289.65 feet to a ~~~ square metal tube set in the South line of Street Dedication (Vol. 476 9 Page 531) for the Northwest corner of this tract; THENCE North 89°03'40" E. 168.60 feet to the Place of Beginning. SUBJECT TO THE FOLLOWING CONDITION: a. That the uses be limited to parking, office space and enclosed storage space. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law.
