AN ORDINANCE AMENDING CHAPTER 12A OF THE CODE OF ORDINANCES OF THE CITY OF
LUBBOCK, ENTITLED "FLOOD HAZARD AREAS", BY AMENDING SECTION 12A-4 THEREOF GOV-
ERNING THE BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD; AMENDING
SECTION 12A-7 GOVERNING VARIANCE PROCEDURES; AMENDING SECTION 12A-8 GOVERNING
PROVISIONS FOR FLOOD HAZARD REDUCTION; PROVIDING A SAVINGS CLAUSE; PROVIDING
FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CODE OF ORDINANCES OF THE CITY
OF LUBBOCK; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council has determined that it would be in the best in-
terest, health, safety and general welfare of the citizens of the City of
Lubbock to make the changes indicated below; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 12A-4 of Chapter 12A of the Code of Ordinances
I of the City of Lubbock, BE and is_ hereby amended in part by amending sub-
section (b) to read as follows:

"(b) Basis for Establishing the Areas of Special Flood Hazard. The areas
of special flood hazard identified by the Federal Insurance Administration
in a scientific and engineering report entitled 'The Flood Insurance Study
for the City of Lubbock', dated March 2, 1982, with accompanying Flood
Insurance Rate Maps and Flood Hazard Boundary-Floodway Maps and any re-
visions thereto are hereby adopted by reference and declared to be a part
of this chapter."
il l SECTION 2. THAT Section 12A-7 of Chapter 12A of the Code of Ordinances
of the City of Lubbock, BE and is hereby amended in part by amending sub-
section (i)(3) to read as follows:
"(i)(3) Any applicant to whom a variance is granted shall be given
written notice that the structure will be permitted to be built with a
lowest floor elevation below the base flood elevation and that the cost of
flood insurance will be commensurate with the increased risk resulting
from the reduced lowest floor elevation."
1 SECTION 3. THAT Section 12A-8 of Chapter 12A of the Code of Ordinances
·lof the City of Lubbock, BE and is hereby amended in part by amending sub-
!lsection (a) by adding a new subparagraph to be designated subparagrap~ (a)(7),
:1 which shall read as follows:
"(a)(7) All mobile homes shall be anchored to resist flotation, collapse,
or lateral movement by providing over-the-top and frame ties to ground
anchors. Special requirements shall be that:
a. over-the-top ties be provided at each of the four corners of the
mobile home, with two additional ties per side at intermediate
locations, with mobile homes less than 50 feet long requiring one
additional tie per side;

frame ties be provided at each corner of the home with five additional
ties per side at intermediate points, with mobile homes less than SO
feet long requiring four additional ties per side;
all components of the anchoring system be capable of carrying a force
of 4,800 pounds; and
any additions to the mobile home be similarly anchored."
\ SECTION 4. THAT Section 12A-8 of Chapter 12A-8 of the Code of Ordin-
l1ances of the City of Lubbock, BE and is hereby amended in part by amending sub-
1section (b)(J)b to read as follows:

"(b)(3)b. All mobile homes shall be anchored to resist flotation, collapse
or lateral movement, in accordance with sub-section 12A-8(a)(7)."

jAnd further amending said sub-section (b)(3) by adding a new subparagraph
jthereto to be designated subparagraph (b)(J)c, which shall read as follows:

"(b)(J)c. For new mobile home parks and subdivisions; for expansions to
existing mobile home parks and mobile home subdivisions; for existing
mobile home parks and subdivisions where the repair, reconstruction or
improvement of the streets, utilities and pads equal or exceed SO percent
of the value of the streets, utilities and pads before the repair, recon-
struction or improvement has commenced; and for mobile homes not placed in
a mobile home park or mobile home subdivision:
(i) stands or lots shall be elevated on compacted fill or on pilings so
that the lowest floor of the mobile home will be at or above the base
flood level. A registered professional engineer, architect or land sur-
veyor shall submit a certification to the City Manager that the standard
of this paragraph complies with sub-section 12A-8(b)(l).
(ii) adequate surface drainage and access for a hauler shall be provided;
and
(iii) in the instance of elevation on pilings: (1) lots shall be large
enough to permit steps, (2) piling foundations shall be placed in stable
soil no more than ten feet apart, and (3) reinforcement shall be provided
for pilings more than six feet above the ground level."
SECTION S. THAT Section 12A-8 of Chapter 12A of the Code of Ordinances
of the City of Lubbock, BE and is hereby amended in part by adding a new sub-
section (d) to read as follows:
"(d) Floodways •. Located within areas of special flood hazard established
in sub-section 12A-4(b) are areas designated as floodways. The following
provisions shall apply to such areas:
(1) Encroachments are prohibited, including fill, new construction, sub-
stantial improvements and other developments unless certification by a
registered professional engineer or architect is provided demonstrating
that encroachments shall not result in any increase in flood levels during
occurrence of the base flood discharge.

(2) If subparagraph (1) above is satisfied, all new construction and sub-
stantial improvements shall comply with all applicable flood hazard re-
duction provisions of Section 12A-8.
(3) Placement of any mobile homes is prohibited except in an existing
mobile home park or mobile home subdivision.
SECTION 6. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 7. THAT violation of any provisions of this Ordinance shall be
deemed a misdemeanor punishable by a fine not to exceed Two Hundred :Dollars
($200.00) as provided in Section 1-5 of the Code of Ordinances of the City of
Lubbock.
SECTION 8. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption and penalty clause of this Ordinance as an
alternative method provided by law.
