AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BEING
THE ZONING CODE, SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2351;.
CHANGE A TRACT OF LAND OUT OF SECTION 17, BLOCK A, GENERALLY DESCRIBED AS
BEING 190 FEET WEST OF THE UNIVERSITY AVENUE CENTER LINE OF THE STREAMBED OF
THE YELLOWHOUSE FORK OF THE DOUBLE MOUNTAIN FORK OF THE BRAZOS RIVER, CITY OF
LUBBOCK, LUBBOCK COUNTY, TEXAS FROM R-1 TO R-1 (DH) ZONING DISTRICT; DESIG-
NATING A LANDMARK THEREON; IDENTIFYING CERTAIN EXTERIOR ARCHITECTURAL FEATURES
OF THAT LANDMARK; PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE
CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the Austin Brothers Bridge located in the Canyon Lakes Project
is a steel Warren-type pony truss bridge built in 1913 across Yellowhouse
Canyon on the Lubbock-Abernathy-Plainview road, and
WHEREAS, the bridge was built by the Austin Brothers Bridge Company of
Dallas for the Lubbock County Commissioners, and
WHEREAS, the bridge is symbolic of Lubbock's early development as a
transportation center, with highways and rail lines extending across West
Texas in all directions from Lubbock, and
WHEREAS, the bridge is also symbolic of Lubbock's early dependence on
the automobile and highway travel, which began as early as 1907, when Rollie
Burns and Frank Wheelock operated an auto stage line to Amarillo by way of
Plainview, and
WHEREAS the bridge was restored to its original condition in 1974 by
the City of Lubbock in collaboration with the History of Engineering Program
and the Civil Engineering Department of Texas Tech University for use as a
pedestrian footbridge in the Lubbock Canyon Lakes Project, and
WHEREAS, the proposed change in zoning as hereinafter made has been duly
presented to the Planning and Zoning Commission for its recommendation which
was received by the City Council and, after due consideration, the City
Council finds that it would be in the best interest of the public welfare to
make the proposed change in zoning, and
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 26 of Ordinance No. 7084, as well
as notices and provided by Article 1011f, Vernon's Annotated Civil Statutes,
amended in 1961, and notice was duly published in the Lubbock MOrning
Avalanche-Journal more than fifteen (15) days prior to the date of the public
hearing before the City Council on such proposed amendment, and the public
hearing according to said notice was duly held in the City Council Room on
the second floor of the City Hall, Lubbock, Texas, at which time persons
appeared in support of the proposal; and, after said hearing, it was by the
City Council determined that it would be in the public interest, due to
cchanged conditions, that the Zoning Ordinance and the Zoning Map be amended
in the manner hereinafter set forth in the body of this Ordinance and this
Ordinance having been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2351
SECTION 1. THAT the tract of land out of Section 17, Block A,
City of Lubbock, Lubbock County, Texas, BE and is hereby changed from R-1
to R-1 (DR) zoning district, and declared to be a historic landmark
district.
SECTION 2. THAT the bridge located thereon BE and is hereby declared
to be a historic landmark.
SECTION 3. THAT the following BE and are hereby declared to be
exterior architectural features, and as such shall be preserved in their
present form:
1. All steel chords, panels, posts, beams, and braces characteristic
of Warren-type Pony truss construction,
2. Wooden plank deck,
3. All steel parts shall be painted as needed for protection and
appearance, with a color of paint similar to that used at present
or contemporary and appropriate to its original use.
SECTION 4. THAT incorporated by reference into this ordinance, and by
attaching hereto, are photographs of the structure as it presently appears.
Said photographs shall be used to indicate the degree of alteration which has
already occurred and the degree of preservation of the original structure.

SECTION 5. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars
as provided in Section 1-5 of the City Code.
SECTION 6. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 7. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method·provided by law.
