AN ORDINANCE by the City Council of the City Ofl Lubboc~.J U
Texas, amending ordinance No. 8332 and ch~' ging
the interest rates on certain "City of Lu ock,
Texas 1 General Obligation Bonds 1 Series 1 182";
ordaining other matters incident and rela~ed
thereto; and declaring an emergency. j' ·
WHEREAS, on the 28th day of May, 1982, the Cit . Council
of the City of Lubbock, Texas, finally passed and aqopted an
Ordinance No. 8332 authorizing the issuance of $10,~50,000
"City of Lubbock, Texas, General Obligation Bonds, ~eries
1982"{the "Bonds") for the purpose of making perman~nt
public improvements, to wit: $8121000 for construcJing,
improving and expanding.the City's Airport Terminal facilities,
and including terminal apron improvements; $1,090,0 ,0 for
constructing improvements and extensions to the City's
sanitary sewer system; $3,280,000 for constructing ~treet
improvements in and for said City, including lighti g;
$4,283,000 for improving, extending and equipping t e City's
traffic signalization system;. $250,000 for constructing,
improving and equipping fire station buildings in a1d for
said City and the purchase of necessary sites therefor;
$1,000,000-for constructing, improving or expanding 1health
facilities, including the purchase of necessary sit!s therefor;
$235,000 for constructing, enlarging; extending and installing
storm sewers, drains and gutters, and other improve ents
incidental thereto, including acquisition of land f~r drainage
purposes and drainage area modifications for mosquiro control;
and
WHEREAS, this Council finds and·determines tha~
have been printed with interest rates which yield ap
rate of 10.79198% whereas the appropriate and propef
rate is 10.591282%; and 1

WHEREAS, the improper interest rates were supp~ied to
the printer of the Bonds, without fault of the emplpyees
of the City, and the same was discovered prior to tpe
scheduled delivery of the Bonds, and it is now appr~· priate
for this governing·body to amend the aforesaid ordi ance
in compliance with the bid accepted by the City; an.
I WHEREAS, the adoption of this ordinance as an~mergency
measure is for the i~ediate preservation of the p lie peace,
property, health and safety of the citizens of the 1 ity in
that the improvements.for which said Bonds are authorized
to be issued are needed to be made and the immedia~e effect
of this.ordinance will permit the Bonds to be deli~ered
within the time period provided in the original no~ice of
sale; now, therefore, J'
BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT , OF
LUBBOCK I TEXAS : I I
SECTION 1: That Section 2 of Ordinance No.I 8332
finally passed and adopted on May 28, 1982, authorizing the
issuance of "City of Lubbock, Texas, General Oblig~tion
.Bonds, Series 1982" shall be and the same is hereb~ amended
to read as follows: 1
" · SECTION 2: That said bonds shall be 1ated June
1, 1982; shall be numbered consecutively from One {ll
through T~1o Thousand One Hundred Ninety (2 ,19 , ) ; shall
each be in the denomination of Five Thousand ~llars
($5,000), and shall become due and payable sef'ially on
February 1 in each of the years and bear inte est at
the per annum rates in accordance with the fo lowing

PROVIDED, HOWEVER, the City reserves the right to
redeem the bonds of this series maturing on February 1,
1993, and subsequent, in whole or any part thereof, on
February 1, 1992, or on any interest payment date
thereafter, at the price of par and accrued interest to
the date fixed for redemption; PROVIDED, FURTHER, that
at least thirty (30) days prior to a date any_of said
bonds are tQ be redeemed, a notice of redemption,
signed.by the City Secretary {specifying the serial
numbers and amount of bonds to be redeemed) shall have
been filed with CITIBANK, N.A., New York, New York, and
the TEXAS COMMERCE BANK, NATIONAL ASSOCIATION,.Lubbock,
Texas, (the paying agents named in each of said bOnds):
and if the City shall have made available by the
date funds sufficient to pay the bonds to be redeemed
and accrued interest thereon, any bond or bond~ not
presented for redemption pursuant to such notice shall
cease to bear interest from and after the date so fixed
for redemption."
SECTION 2: That the Mayor and City Secretary of the
City are hereby authorized and directed to make arrangements
for the reprinting of such bonds and the cancellation by the
Comptroller of Public Accounts of the bonds originally
printed.
SECTION 3: That, save and except for.the akendment
of Section 2 of Ordinance No. 8332 passed and adoptbd on ~!ay
28, 1982, all other Sections and provisions of said Ordinance
are hereby ratified and affirmed.
SECTION 4: That the public importance of this
measure and the fact that it is to the best interest of the
City of Lubbock to provide funds for the purpose of conducting
the prog~am of improvements for which the bonds were authorized
at the earliest possible date for the immediate preservation
of the public peace, property, health and safety of, the
citizens of said City constitute and create an eme~gency a~c

AS BOND COUNSEL FOR THE CITY, we have examined certi~ied copy
of the proceedings of the City Council of the City of Lubbock, Lubbock
County, Texas, passed and adopted preliminary to the issu~nce by said
City of its bonds dated June 1, 1982, in the principal s~ of TEN
MILLION NINE HUNDRED FIFTY THOUSAND DOLLARS ($10,950,000}'!', more
particularly described as follows: .
CITY OF LUBBOCK, TEXAS, GENERAL OBLIGATION BONDS, SE~IES
1~82, numbered consecutively from 1 through 21~0, each in
the denomination of $5,000, maturing serially on February 1
in each of the years 1983 through 2002, bonds maturing in
the years 1993 through 2002, being subject to redemption,
in whole or any part thereof, on February 1, 1992, o~ on
any interest payment date thereafter at par and accr6ed interest. ! ..
THE BONDS OF THIS SERIES bear interest from date to maturity,
or the redemption thereof in accordance with the te~s
prescribed therefor, at· the per annum rates shown asj follows:
I bonds maturing in the years 1983 through 1990 at 1 2.00%1
bonds maturing in the year 1991 at 11.60%;
bonds maturing in the year 1992 at 10.00%;
bonds maturing in the year 1993 at 10.25%;
bonds maturing in the year 1994 at 10.40%;
bonds maturing in the year 1995 at 10.60%;
bonds maturing in the year 1996 at 10.75%;
bonds maturing in the year 1997 at 11. 00%; and

IT IS OUR OPINION that said proceedings and other :showings
tendered in connection therewith evidence that all of said bonds were
duly authorized and issued in conformity with the Constitution and
laws of the State of Texas now in force= that said issue to the amount
of $10,950,000, aforesaid, is valid and.legally binding! upon said
City; and that the interest on and principal of said bdnds are
payable from ad valorem taxes levied upon all taxable property within
said City, within the limitations prescribed by law. '
IT IS OUR FURTHER OPINION that the interest on suqh bonds is
exempt from present fede.ral income taxes under existing statutes,
regulations, rulings and court decisions.
i . WE HAVE ACTED AS BOND COUNSEL for the City for th~ sole purpose
of rendering an opinion with respect to the legality a~d validity
of the bonds of this series under the Constitution and laws of the

series from the Comptroller of Public Accounts and one· copy
of the· approving opinion of the Attorney General. At such
. time as you have received the bonds1 we ask that Bond Number
One and the copy of the approving opinion of the Attorney

Texas 75201 for their examination and return. When the bond
has been returned to you, this will be your authority,to
deliver·said bonds to the purchasers thereof, Republic.Bank Dallas N.A., Manager & Associates
or their order , __ upon payment therefor in accordance with the
terms of the Treasurer's Receipt forwarded to you, said
payment to be made in immediately availa.Ple funds transmitted
by fastest means to the depository bank. '
Enclosed herewith you will find four Signature and
No-Litigation Certificates, executed and completed except as
to date. When the bonds have been taken up and paid for,
kindly date and release one copy of this certificate to the
purchaser and the remaining copies to Messrs., Dumas, ,Huguenin, Boothman and Morrow, Attorneys,. Dallas, Texas.. ·
Should a1l:t-~itigation having any effec~ upon the: subject
bonds develop prior to the time you have received pa~tent
for the bonds we, the undersigned, will notify you ationce
by telephone and by telegraph. You may thus be assur~d that
there is no such litigation at the time the bonds are. delivered
to you unless you have been advised otherwise in the manner
aforementioned.
