, AN·ORDINANCE SETTING A SPECIAL ELECTION OF THE CITY OF L BBOCK, TEXAS, FOR
THE 15TH DAY OF JANUARY, 1983, FOR THE PURPOSE OF SUBMITTING 0 THE QUALIFIED
VOTERS OF THE CITY OF LUBBOCK FOR ADOPTION OR REJECTION PROPOSED AMENDMENTS TO
THE EXISTING CHARTER OF THE CITY OF LUBBOCK; SETTING FORTH T~ LANGUAGE OF SUCH
PROPOSED CHARTER AMENDMENTS; AND PROVIDING FOR PUBLICATION OF ~OTICE OF SUCH
ELECTION IN A NEWSPAPER OF GENERAL CIRCULATION IN THE.CITY OF !LUBBOCK ON THE
jsAME DAY IN EACH OF TWO SUCCESSIVE WEEKS WITH FIRST PUBLICATI ' NOT LESS THAN
!FOURTEEN (14) DAYS PRIOR TO SAID ELECTION.
I I WHEREAS, the City Council of the City of Lubbock deems it proper to submit
to the qualified voters of the City of Lubbock proposed amend ents to the
existing Charter of the City of Lubbock, which proposed amen nts are hereafter
stated, at a special election for the purpose of adoption or rejection of such
proposed amendments; and I I
WHEREAS, the provisions of Vernon's Ann.Civ.St., Art. 117p; the Texas
Election Code and the 1965 Voting Rights Act, when read toget · r, indicate that
the next available date for such special election is January 1 , 1983; and
WHEREAS, the City of Lubbock has not amended its Charter ithin the past
two years immediately preceding January 15, 1983; NOW THEREFO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
I SECTION 1. THAT a special election be and is hereby o~dered to be held
on the 15th day of January, 1983, at such places and by such e~ection officials
as shall be hereafter designated by the Mayor's Election Orde for the purpose
of submitting to the qulaified voters of the City of Lubbock f r adoption or
rejection the following proposed amendments to the existing C rter of the City
of Lubbock:
AMENDMENT NO. 1
Amending Chapter 1, Article V, of the Charter by adding t ereto a new
Section 5 which is to read as follows:
LIMITATION OF TAX LEVY
Section 5. The annual ad valorem taxes levied by the governing
authority of the City government shall not exceed the rat of $1.12 per
$100.00 valuation of taxable property.

AMENDMENT NO. 2
Amending Chapter 1, Article V, of the Charter by adding t ereto a new
Section 6 which is to read as follows:
LIMITATION ON ASSESSED VALUATION
Section 6. The annual ad valorem taxes levied bj the governing
authority of the City government shall not exceed 60 percent of the fair
market value of the property as the assessed valuation of property subject
to tax.

AMENDMENT NO. 3
Amending Chapter 1, Article V, of the Charter by adding ~hereto a new
Section 7 which is to read as follows:
APPROVAL BY VOTERS ON TAX INCREASE
' I The annual ad valorem taxes levied by the governing :authority of the
City government shall not be increased on the basis of ari increase in the
rate of evaluation of taxable property nor on the assessed valuation of
property subject to tax, from the preceding tax year, without first
securing approval of said increase at an election submitting said proposed
increase to the voters of the City of Lubbock. Said increase, if any,
requiring a majority vote for its approval.

SECTION 2. The official ballot shall be substantially as is set out
above with the words nyes" and "no" appearing beside each proposed amendment so
that voters may indicate their choice on each proposed amendment separately.
SECTION 3. The City Secretary shall give notice of this election by
publication of this ordinance in some newspaper of general circulation published
in the City of Lubbock on the same day of two successive weeks with the date of
first publication being not less than fourteen (14) days priot to January 15,
1983, the date set for this election.
