Seismographic Testing In City Limits Of Lubbock. - 05/10/1982DGV:da I AMENDS ORD. \8291 I ORDINANCE NO. 8333 AN ORDINANCE ADDING A SECTION 19A-27 TO THE CODE OF ORDI ANCES OF THE CITY OF LUBBOCK; REGULATING SEISMOGRAPHIC TESTING WITHIN THE ITY LIMITS OF THE CITY OF LUBBOCK; PROVIDING A SAVINGS CLAUSE; PROVIDING A ENALTY, AND PROVIDING FOR PUBLICATION. WHEREAS, there has been much recent interest testing within the City of Lubbock; and WHEREAS, such testing may involve some potential hazards facilities and equipment and to private property; NOW THEREFO BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT a new Section 19A-27 be added to the of the City of Lubbock, Texas, which shall read as follows: "Sec. 19A-27. Seismographic Testing; Permit Required; seismographic utility e of Ordinances I (A) Permit Required. It shall be unlawful for anyjperson acting for himself or as agent, employee, independent contractof, or servant for another person or corporation to conduct seismographic t sting within the city limits of the City of Lubbock without first obtaini g a valid permit for such activity from the City of Lubbock. !1 (B) Permit Application. Application for seismogra hie testing permits shall be made in writing upon forms supplied by he City Manager or his designee for such purpose not less than ten (10) ~ays prior to the day upon which such testing is intended to be conducted.'!' Such applica- 11 tions shall contain at least the following information: 1. The name of the individual or corporation maki*g application. 2. The name and address of the agent for the pers~n or corporation making application. 3. The approximate date upon which such testing w 11 be done. 4. The location of such testing. i 5. A statement that the applicant has received permission for such testing from the landowner and from all affectld utility com- panys. 6. Evidence of liability insurance in an amount o not less than $300,000.00 for damage to any person's propert as a result of such testing. .I 7. The signature of a person authorized to bind t~e person or corporation making application. : I All applications must be accompanied by a non-refundablelfee of $25.00 to cover the cost of administrative processing and enforcem nt. Further, if such application shall be for testing upon the public st eets of the City of Lubbock, the applicant shall be required to execute alhold harmless agreement for all claims that may be brought against the~City of Lubboc. k by third parties as a result of such testing. No testing shall be done ~ithin the city limits of the City of Lubbock using explosive charges. [f such testing· is to be conducted on public streets within the city lim.its, such testing shall be conducted as near as possible to the righthand curb or edge of the roadway and in all instances at least one ten-foot wide lane of travel shall be left clear of obstruction on the side of! the roadway where testing is being conducted. Testing on public strbets shall be done during daylight hours, not including the hours of 7:30 to 8:30 a.m. and 4:30 to 5:30 p.m. on weekdays and flagmen shall be utilized at all times during testing. Testing on public streets shall not be done on soft shoulders, embankments or within fifty feet of a bridge. (D) Permit Denial or Revocation. A permit may be ~efused if it fails to contain all of the required information or if it is not signed by an authorized individual. A permit may be revoked ifi it is learned that the information contained in the application for such permit is untrue in any respect or that the application was signedjby a person with no authority to sign such application. ' SECTION 2. THAT should any section, paragraph, sentence! clause, phrase or word of this ordinance be declared unconstitutional or inv~lid for any reason, the remainder of this ordinance shall not be affectedlthereby. SECTION 3. THAT violation of any provision of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two h~dred dollars as provided in Sec. 1-5 of the Code of Ordinances of the City ofiLubbock. SECTION 4. THAT the City Secretary is hereby authorizedlto cause pub- liction of the descriptive caption of this ordinance a.s an alternative method provided by law. AND IT lS SO ORDERED.
