CHAPTER 19A WITH REGARD TO ISSUANCE OF SUCH PERMITS; PROVIDING A SAVINGS CLAUSE; i PROVIDING FOR PUBLICATION; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMER-~ ~cr. • ~ WHEREAS, the drilling and operation of oil and gas wells within the city ~ limits of the City of Lubbock is an activity involving considerable potential li hazard to the health, safety and welfare of the citizens of the City of Lubbock;\, ~ r WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of Lubbock to temporarily suspend the issuance of permits for oil and gas well drilling pending further study of appropriate regulation of such activities; and WHEREAS, the potential for damage to the environment and the health, safety and welfare of the citizens makes it necessary for such action to be passed as an emergency measure; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT issuance of permits for oil and gas well drilling under provisions of Chapter 19A of the Code of Ordinances of the City of Lubbock BE and is hereby suspended until June 14, 1982. SECTION 2. THAT such activities as have already been permitted may continue in accordance with applicable provisions of Chapter 19A of the Code of I Ordinances of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. SECTION 5. THAT this Ordinance shall be effective immediately upon passage by the City Council of the City of Lubbock. SECTION 6. THAT the health, safety and welfare of the citizens of the City of Lubbock require that this Ordinance be passed as an emergency measure upon one reading.
