HomeMy WebLinkAboutOrdinance - 8317-1982 - Zoning Ord. #7084 And Lubbock Map Changes: Zone Case #1280-B - 04/22/1982SMH:mck ORDINANCE NO. 8317 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 1280-B; CHANGE LOTS 1 THROUGH 8, AND 10, BLOCK 11 AND LOTS 13.AND 16, BLOCK 7, C. C. LEFTWICH SUBDIVISION, AND A TRACT OF LAND OUT OF SECTION 2, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-4 TO C-4 PROHIBITING DANCE HALLS, NIGHT CLUBS, BARS OR LOUNGES ZONING DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche- Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1280-B SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map Be and the same are hereby amended as follows, to-wit: Change Lots 1 through 8, and 10, Block 11 and Lots 13 and 16, Block 7, C. C. Leftwich Subdivision, and a tract of land out of Section 2, Block E-2, City of Lubbock, Lubbock County, Texas, from C-4 to C-4 prohibiting dance halls, night clubs, bars or lounges Zoning District, (Located north of 19th Street between Peoria Avenue and the railroad tracks), and being further described as follows: Lots 1 through 8, and Lot 10 of Block 11, C. C. Leftwich Subdivision, Second Installment to the City of Lubbock, Lubbock County, Texas; and Lots 13 through 16 of Block 7, C. C. Leftwich Addition to the City of Lubbock, Lubbock County, Texas; and A tract of land out of Section 2, Block E-2, in Lubbock County, Texas and described by metes and bounds as follows: -?, • I! l . ., I BEGINNING at a 3/4" iron pipe located at the intersection of the Northwest right of way line of the Santa Fe Railway with the North right of way line of State Highway, know as the Lubbock-Levelland Highway for the place of beginning; THENCE West along the North right of way line of said State Highway ten feet to a 3/4" iron pipe; THENCE North 57' to a 3/4" iron pipe; THENCE North 54° East parallel to and 52 feet from the Northwest right of way line of said Santa Fe Railway 233.55 feet to a 3/4" iron pipe; THENCE North 80 feet to a point situated in the center ot an East-West alley; THENCE East 207.96 feet to the intersection of the projection of this line with the Northwest right of way line of the said Santa Fe Railway; THENCE Southwesterly along the Northwest right of way line of said Santa Fe Railway 466 feet to the place of beginning; being the same tract of land described in that certain warranty deed dated May 25, 1955, and recorded in Volume 577, at page 573 of the Deed Records of Lubbock County, Texas. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
