ORDINANCE NO. --:8.::::.31::::3::.__ __ AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BEING THE ZONING CODE, SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2361; CHANGE LOTS 3, 4, AND 5, BLOCK 120, OVERTON ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-3 TO C-3 (DH) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the Bacon Home, built in 1916 at 1802 Broadway, is an out- standing example of Neo-Classical style architecture, and WHEREAS, the home is one of the few examples of this type of archi- tecture in the City, and WHEREAS, Warren A. Bacon, a successful businessman, real estate promoter and civic leader, was among the earliest settlers in Lubbock County, and WHEREAS, his wife, Myrta Hunt Bacon, was the daughter of George M. Hunt, who brought his family to Estacado in 1884, moved to Old Lubbock in 1890, and to the new Lubbock townsite in 1891, and WHEREAS, the home was owned by the Bacon family over 65 years, and WHEREAS, the home was purchased by the Episcopal Diocese of Northwest Texas in 1981 for use as its Diocesan offices, and WHEREAS the proposed change in zoning as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that it would be in the best interest of the public welfare to make the proposed change in zoning, and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with,-as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof•r "l;!lOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2361 SECTION 1. THAT Lots 3, 4, and 5, Block 120, Overton Addition, City of Lubbock, Lubbock County, Texas, BE and is hereby changed from C-3 to C-3 (DH) zoning district, and declared to be a historic landmark district. SECTION 2. THAT the principal residence located thereon BE and is hereby declared a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic landmark structure therein, in terms of style, color, materials, texture, and basic form as found in the following style: Neo-Classical Revival, as de-. scribed in the booklet, "Architecture in Lubbock: A Guide for Identification and Preservation," First Edition, 1979. SECTION 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: 1. exterior brick walls, 2. green clay mission tile hipped roof with broad eaves, 3. south and west porticos with plastered Tuscan columns and wooden Chinese railings, 4. south and east hipped dormers, 5. two interior brick chimneys, 6. stone and concrete lintels, sills, keystones, and rails, 7. location and style of all doors and windows. SECTION 5. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shall be used to indicate the degree of alteration which has already occurred and the degree of preservation of the original structure. These photographs shall be further identified as follows: 1. General view, south side 2. General view, east side 3. General view, north side 4. General view, west side 5. Close view, south dormer, portico railing and chimney 6. Close view, typical window .. ' .. ...,. 7. . Close view, art glass windows, west side 8. Close view, typical door 9. Close view, southwest corner of south portico SECTION 6. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars I as provided in Section 1-5 of t~e City Code. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
