ORDINANCE NO. 5136
AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PER-
MIT IN ZONE CASE NO. 1449 TO PROVIDE FOR PUBLIC AND PRIVATE RECREA
TION FACILITIES; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock has received the recom -
mendation of the Planning and Zoning Commission, after due notice and public hear
ing, and all matters having been done and performed as required by Section 14-A
of Zoning Ordinance 1695 of the City of Lubbock, said Ordinance being an appendix
to the Lubbock City Code relating to Specific Use Permits, that a Specific Use Per
mit be issued for a certain parcel of land; and,
WHEREAS, the Council feels that due to changed conditions it would be expe
client and in the interest of the general welfare of the public to authorize the grant·:.
of a Specific Use Permit as hereinafter set forth, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. The Director of Planning of the City of Lubbock is authorized
to issue a Specific Use Permit to the Applicant in Zone Case No. 1449 in accordanc
with the recommendations and conditions imposed by the Planning and Zoning Com· ...
mission, on file in the office of the Director of Planning, and the City Council, whi h
are hereby adopted and incorporated herein by reference for all purposes, provide
said Applicant agrees to be bound by the terms of the Specific Use Permit, the
granting of which is hereby made subject to compliance by said Applicant with all
terms of said Specific Use Permit and further subject to all provisions of Zoning
Ordinance No. 1695 of the City of Lubbock, including particularly but not limited
to, Section 14-A thereof relating to Specific Use Permits. Provided further, that
should said Applicant fail to comply with the terms of this Ordinance and Section
14-A. 4 of Zon ing Ordinance 1695 within Ten Months of the effective date of this
ordinance, the City Secretary shall be and is hereby authorized and instructed,
upon written notice from the Director of Planning that Applicant has not complied
with the provisions. conditions and terms imposed by this ordinance, to note Ap ...

hereby revoked; and the Director of Planning in such event is directed to remove
from the Zoning Map the legend indicating such limited use. The Specific Use auth
orized by this Ordinance is for public and private recreation facilities pursuant to
Section 14 .. A. 1 -14 ... 1 of the Zoning Ordinance and the property is located on a trac
of land out of Section 28> Block E-2, Lubbock County> Texas, said tract being mor
particularly described by metes and bounds as follows, to-wit:
BEGINNING at a point in the east line of Section 28, Block E--2,
26401 South of the Northeast corner of said(Section 28;
THENCE North along the center line of Slide Road a distance
of 660r;
THENCE West, parallel to the North line of Section 28~ a
distance of 1060t;
THENCE South, parallel to the East line of Section 28, a
distance of 660t;
THENCE East along the half section line a distance of 1osor
to the PLACE OF BEGINNING.
SECTION 2. The City Secretary shall cause the publication of this Ordi-
nance once a week for two consecutive weeks in a newspaper regularly published
in the City of Lubbock.
AND IT IS SO ORDERED.
