TEXAS~ FROM AN "R ... 2" TO AN "R ... 3" AND "C ... 4" ZONING DISTRICT. SUBJECT TO CONDITIONS. WHEREAS. the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendation. which was received by the City Councfi and after due consideration, the City Councfi finds that making the proposed change as hereinafter set out will be in the public interest; and I WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully compled with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 and as well as notices provided by Article 1011f, Vernonrs Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubboc~ Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be• in the public irterest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amend ... ed in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW~ THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO~-1484 Change a tract of land out of Section 8, Block B, Lubbock County, Texas., from an "R ... 2u to an "R .. J" and "C ... 4" Zoning District. A tract of land out of Section 8, Block B, Lubbock County .. Texas, further described to wit: That property in the City of Lubbock bordered on the north by 42nd Street, on the West by Avenue J, on the east by Avenue H, and on the South by the alley north of 44th Street and by the North line of Lot 2. Block A, Butler Es.tates.' KJ:jkb Change to Ce-4: The East 140t· of above described property. Change to Rfll3: All Except the East 140t of above described property SUBJECT TO THE FOLLOWING CONDITIONS: (Applies to R•3 only) 1. Development shall be limited to apartments only. 2. That a minimum of 1500 square feet of lot area be provided for each apartment unit. 3. That 1 1/2 paved off street parking spaces be provided for each 1 bedroom apartment unit and 2 paved off street parking spaces be provided for each 2 bedroom apartment unit. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith.
