HomeMy WebLinkAboutOrdinance - 8286-1982 - Amend Ord #7084 And Lubbock Map Changes: Zoning Code #2352 - 02/11/1982ORDINANCE N0.8286 AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BEING THE ZONING CODE, SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 2352; CHANGE A TRACT OF LAND OUT OF SECTION 17, BLOCK A, GENERALLY DESCRIBED AS BEING 1060 FEET WEST OF UNIVERSITY AVENUE CENTER LINE AND 660 FEET SOUTH OF MARSHALL STREET, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM R~1 TO R-1 (DH) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the Landwer-Manicapelli home in the Canyon Lakes Project is an example of the Spanish Mission style popular in the 1920's and 1930's, and WHEREAS, the home was built in 1936 by Milton Frederick Landwer, professor of biology at Texas Technological College from 1927 until his retirement, and WHEREAS, Mr. and Mrs. Joe Manicapelli bought the house from the Landwers after World War II and lived in it until the property was acquired by the City as part of the Canyon Lakes Project, and WHEREAS, the house was renovated by the City of Lubbock for use as a party house and community center in the Canyon Lakes Project, and WHEREAS, the proposed change in zoning as hereinafter made· has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that it would be in the best interest of the public welfare to make the proposed change in zoning, and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ,•, ZONE CASE NO. 2352 SECTION 1. THAT a tract of land, Section 17, Block A, C:ity of Lubbock, Lubbock County, Texas, BE and is hereby changed from R-1 to R-1 (DB) zoning district, and declared to be a historic landmark district. SECTION 2. THAT the principal residence located thereon BE and is hereby declared a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic landmark structure therein, in terms of style, color, materials, texture, and basic form as found in one of the follwing styles: Mission, Spanish Colonial, or Pueblo, as described in the booklet, "Architecture in Lubbock: A Guide for Identification and Preservation," First Edition, 1979. SECTION 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: 1. exterior walls, 2. red clay barrel tile roof, 3. stuccoed chimney with ornamentation, 4. arched window and entry openings, 5. the location of the doors and windows, 6. stuccoed walls. SECTION 5. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shall be used to indicate the degree of alteration which has already occurred and the degree of preservation of the original structure. These photographs shall be further identified as follows: NO. 1: NO. 2: NO. 3: NO. 4: NO. 5: NO. 6: General view, east side. General view, west side. General view, north side. General view, south side. Close view, entrance on east side. Close view, tile roof. SECTION 6. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
