HomeMy WebLinkAboutOrdinance - 8282-1982 - Zone Case #2347: Change Lot 12, Blk 84, Overton Addition. - 02/11/1982-, ORDINANCE NO. 8282 AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK BEING THE ZONING CODE SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2347: CHANGE LOT 12, BLOCK 84, OVERTON ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-2 TO C-2 (DH) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; I INDENTIFYING CERTAIN EXTERIOR ARCHITECTURAL FEATURES OF THAT LANDMARK; I PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. . I WHEREAS, the Mast-White home located at 2301 Broadway is a fine example of vernacular Victorian architecture built at 2219 13th in the Overton Addition in 1925 by A.M. Hensley for Clarence S. Mast, Sr., a professor of physics and a member of the original faculty of Texas Technolog- ical College, and WHEREAS, the home was purchased in 1948 by Lester 0. and Ercil White, both City of Lubbock employees, who lived in the house for 20 years and are fondly remembered as "Pop" and "Mom" White by innumerable Tech students who considered this house their home away from home, and WHEREAS, the house was acquired in 1978 by the First Baptist Church and donated to the Lubbock Heritage Society, which relocated it to 2301 Broadway in October 1981 to stand as a visible example of community cooperation for preservation a~d adaptive use of the heritage resources of the City of Lubbock, and WHEREAS, the proposed change in zoning as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that it would be in the best interest of the public welfare to make the proposed change in zoning, and WHEREAS, all conditions.precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2347 SECTION 1. THAT Lot 12, Block 84, Overton Addition, City of Lubbock, Lubbock County, Texas, BE and is hereby changed from C-2 to C-2 (DH) zoning district, and declared to be a historic landmark district. SECTION 2. THAT the principal residence located thereon BE and is hereby declared to be a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic landmark structure therein, in terms of style, color, materials, texture, and basic form as found in one of the following styles: Victorian, Federal, or Georgian Revival, as described in the booklet, "Architecture in Lubbock: A Guide for Identification and Preservation," First Edition, 1979. SECTION 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: 1. exterior walls and roof, 2. the location of the doors and windows, 3. the covered porch with columns in groups of three around the front entry, 4. the second floor bay window over the front entry, 5. the dormer over the second floor bay window, 6. the wood siding, 7. the covered porch on the east side, supported by columns in groups of two and three, with approved alterations, 8. the dormer on the rear of the house, 9. the balustrade on the east porch, 10. the wood surfaces shall be kept painted as needed for protection and appearance, with a color of paint similar to that used at present or contemporary and appropriate to its orginal use. SECTION 5. THAT incorporated by reference into this ordinance, and by attaching·hereto, are photographs of the building as it presently appears. Said photographs shall be used to indicate the degree of alteration which has already occurred and the degree of preservation of the original structure. NO. 4: Front entrance and porch view from the north. NO. 5: Close view of dormer from the north. NO. 6: Close view of bay window from the north. SECTION 6. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
