AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF TH CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2346; CHANGE A TRACT OF LAND OUT OF SECTION 25, BLOCK A, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM T TO IDP ZONING DISTRICT; PROVIDING FOR A PENALTY AS PRO- VIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PRO- VIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning .Connnission for its recommendation which wa received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed change in zoning; and I 1 WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more tha fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal• and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance an the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY .THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2346 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map Be and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 25, Block A, City of Lubbock, Lubboc County, Texas, from T to IDP Zoning District. This property is further described by metes and bounds as follows, to-wit: BEGINNING at a 3/4" iron pipe set at the point of intersection of the West line of the said Section 25 with the Northwesterly right-of-way line of U.S. Highway 62-82 for the SW corner of this tract, from which a½" iron pipe found at SW corner of Section 25 bears S 00°, 29'45" East 125.15 feet; THENCE North 00° 29'45" West, along the West line of Section 25, a distanc of 680.20 feet to a 3/4" iron pipe set for the NW corner of this tract; THENCE North 89° 20'15" East, parallel to the South line of Section 25, a distance of 832.0 feet to a 3/4" iron pipe set in the Northwesterly right- of-way line of U.S. Highway 62-82 for the East corner of Section 25 from .. which a concrete right-of-way marker found at a bend in the right-of-way line bears North 45° 52' East 277.1 feet; THENCE South 45° 52' West 707.1 feet to a concrete right-of-way marker found at a bend in right-of-way line; THENCE South 60° 28' West 317.45 feet to a 3/4" iron pipe set at a bend in said right-of-way line; THENCE South 45° 52' West 58.8 feet to the PLACE OF BEGINNING. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publi cation of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
