For Conduct Election And Other - 09/10/1981-ORDINANCE NO. 8241 AN ORDINANCE by the City Council of the City of Lubbock, Texas, calling a bond election to be held within said City, making provision for the conduct of the election and other provisions incident and related to the purpose of this ordinance. WHEREAS, the City Council of Lubbock, Texas, has determined that an election should be held to ascertain whether said governing J;>ody shall be authorized to issue bonds of said City in t~e amounts and for the purposes hereinafter mentioned; therefore, ! BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: SECTION 1: That an election be held on. the 21st day of November, 1981, which date is not less than fifteen (15) nor more than ninety (90) days from the date of the adoption hereof, at which election the following propositions shall be submitted: PROPOSITION 1 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue $9,495,000 general obligation bonds of said City for th·e purpose of making permanent public improvements, to wit: constructing street improvemeu~s in and for said City, including lighting; said bonds to be issued in one or more installments, to mature serially over a period of years not to exceed FORTY(40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and shall there be levied, assessed and collected annually ad.valorem taxes on all taxable property in the City sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION 2 "SHALL the City Council of the City of Lubbock, Texas,. be authorized to issue $12,854,000 general obligation bonds. of said City for the purpose of hlaking permanent public improvements, to wit; constructing, improving, and expanding the City's Airport Terminal facilities, and including terminal apron improvements; said bonds to be issued in one or more installments, to mature serially over a period of years not to exceed FORTY(40) years from their date, to be issued and sold. a·t any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and. shall there be levied, assessed and collected annually ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" ' :~ PROPOSITION 3 "SE • .l.LL the City Council of the City of Lubbock, Texas, be authorized to issue $1,000,000 general obligation bonds of said City for the purpose of making permanent public improvements, to wit; constructing, improving or expanding liealth facilities including the purchase of necessary sites therefor; said bonds to be issued in one or more installments, to mature serially over a period of years not to exceed FORTY(40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and shall there be levied, assessed and collected annually ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION 4 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue $877,000 general obligation bonds of said City for the purpose of making permanent public improvements, to wit; constructing, improving, and equipping fire station buildings in and for said City and the purchase of necessary sites therefor; said bonds to be issued in one or more installments, to mature serially over a period of years not to exceed FORTY(40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and shall there be levied, assessed and collected annually ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they · become due?" PROPOSITION 5 ttSHALL the City Council of the City of Lubbock, Texas, be authorized to issue $920,000 general obligation bonds of said City for the purpose ofmaki.ng·permanent public improvements, to wit: acquiring, constructing and improving recreational and athletic facilities; said bonds to be issued in one or more installments, to. mature serially over a period of years not to exceed FORTY(40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and shall there be levied, assessed and collected annually ad ,_ .. valorem taxes on all taxable property in the City sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they ,··become due?" PROPOSITION 6 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue $4,283,000 general obligation bonds of said City for the purpose of making permanent public improvements, to wit: improving, extending and equiping the City's traffic signalization system; said bonds to be issued in one or more installments, to mature serially over a period of years not to exceed FORTY(40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and shall there be levied, assessed and collected annually ad valorem taxes on all taxable property in the City sufficient to pay the annual interest. and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION 7 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue $5,226,000 general obligation bonds of said City for the purpose of making permanent public improvements, to wit: constructing improvements and extensions to the City's waterworks system~ including acquisition of water supply; said bonds to be issued in one or more installments, to mature serially over a period of years not to exceed FORTY{40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and shall there be levied, assessed and collected annually ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION 8 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue $7,892,000 general obligation bonds of-said City for the purpose of making permanent public improvements, to wit: constructing improvements and extensions to the City'a sanitary sewer system; said. bonds to be issued in one or more installments, to mature serially over a period of years not to exceed FORTY{40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance; and shall there be levied, assessed and collected. annually ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" SECTION 2: Than an electronic voting system shall be used at each polling place on the date of the election and paper ballots shall be used for absentee voting by personal appearance and by mail. Richardson Clerk On election day, the polls shall be open from 7:00 A.M. to 7: 00 P .M. SECTION 4: Each Presiding Judge shall appoint not less than two (2) nor more than three (_3 __ ) qualified clerks to serve and assist in holding said election; provided that if the Presiding Judge herein appointed actually serves, the Alternate Presiding Judge shall be one of the clerks. Absentee voting shall be conducted at the City Secretary's Office in the City Hall, in accordance with the provisions of V.A.T.S. Election Code, Chapter 5, and a Special Canvassing Board shall canvass the absentee ballots. That the Central Counting Station for the tabulation and counting of ballots for said election shall be located at the City of Lubbock, Municipal Building, and the following persons are hereby appointed and designated by this governing body as the Presiding Judge and Alternate Presiding Judge at the Central Counting Station •. Cervantez, Sr. Bill McCullough The Manager and Presiding Judge of the Central Counting Station shall appoint clerks to serve at such Station, as provided by Chapter 7 of the Election Code. SECTION 5: That all resident qualified electors of the City shall be permitted to vote at said election. This election shall be held and conducted in accordance with the Texas Election Code except as modified by Chapter 1 of Title 22, V.A.T.C.S., and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. SECTION 6: That a substantial copy of this resolution and order shall serve as proper notice of said election. Said notice, including a Spanish translation thereof, shall be posted at three (3) public places within the City and at the City Hall not less than fourteen (14) full days prior to the date on which said election is to be held, and be published on the .same day in each of two successive weeks in a newspaper of general circulation in said City, the first of said publications to be made not less than fourteen (14) full days prior to the date set for said election. of PASSED AND APPROVED, on the first reading on the 10th day September , 1981.
