ORDINANCE NO. 8238 --------Amends Ord. 8203 AN ORDINANCE AMENDING CERTAIN PROVISIONS OF THE CODE OF ORDINANCES OF THE
CITY OF LUBBOCK PERTAINING TO WRECKER OPERATIONS WITHIN THE CITY OF LUBBOCK;
PROVIDING A SAVINGS CLAUS,E; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council has determined that it would be in the best
interests of the citizens of the City of Lubbock to amend certain provisions o
the Code of Ordinances pertaining to wrecker operations within the City of
Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 31-65(a)(5) of the Code of Ordinances of the
City of Lubbock, Texas, be amended to read as follows:
(5) A statement from the City Tax Assessor-Collector that all
City of Lubbock taxes on the permit applicant's property, both
real and personal, to be used in the business are current.
SECTION 2. THAT Section 31-67 of the Code of Ordinances of the City o
Lubbock, Texas, be amended to read as follows:
Sec. 31-67. Wrecker requirements.
Wreckers shall be classified as Class I or Class II and shall
meet the following equipment requirements.
(a) Class I Wreckers.
(1) Shall not be less than one (1) ton in capacity,· as
reflected on the manufacturer's certificate, title or by certi-
fication of capacity by a mechanical engineer licensed as a
professional engineer in the state of Texas.
(2) Shall be equipped with booster brakes.
(3) Shall be equipped with a power operated winch, winch
line and boom with a rated or tested lifting capacity of not
less than six thousand (6,000) pounds single line capacity.
(4) Shall carry as standard equipment at least one of
each of the following: tow bar, safety chain and fire extin-
guisher. If such wrecker is to be used in collision hauls, it
shall also carry a wrecker bar, broom, axe, shovel and dolly.
(5) Shall display the permit number of the permit holder
as reflected on the permit in letters at least three (3) inches

high on each side of the wrecker. Such numbers shall be
permanently attached, legible, and on a contrasting background.
Nothing herein shall be construed as prohibiting the display
of the name of the wrecker business upon a wrecker.
(6) Shall be in such a condition that it can safely and
reliably be used as a wrecker.
(7) Shall comply with the motor vehicle equipment laws
of the State of Texas.
(b) Class 11 Wreckers.
(1) Shall, in addition to the above requirements, be not
less than three (3) tons in capacity; as reflected on the
manufacturers certificate, title or by certification of
capacity by a mechanical engineer licensed as a professional
engineer in . the state of . T·exas.
SECTION 3. THAT Section 31-68 of the Code of Ordinances of the
City of Lubbock, Texas, be amended to read as follows:
Sec. 31-68 .. Insurance.
All permit holders shall maintain public liability and property
damage insurance in the following minimum amounts:
Class I Wreckers;
For d~ges arising out of bodily injury to or
death of one person in any one collision ............. $100,000.00
For damages arising out of bodily injury to or
death of two or more persons in any one collision ••• $300,000.00
For damage to or destruction of property in any
one collision .. -..............•.... -.................. $ 50,000.00
Fo~ general ga~age liab;Uity.(Hazard II) ................ $ 10,000 .. 00
Class II Wreckers:
Requirements shall be the same as for Class I wreckers,
except that cargo insurance shall be required in an amount
of at least $75,000.00
