ANCES ENTITLED 11PARKS11; BY ADDING THERETO SECTIONS PROVIDING FOR UNLAWFUL ACTIVITIES WITHIN PARKS; PRESCRIBING A PENALTY FOR VIOLATION, PROVIDING A SAVINGS CLAUSE,. AND PROVIDING FOR PUBLI ... CATION. . WHEREAS, the City Council of the City of Lubbock has found that the existing regulations governing parks and park activities do not provide the max- imum use of such parks for the comfort, convenience and safety of all the citizens of the City~f Lubbock; and., WHEREAS~ the City Council finds that :regulations of activities in the pub ... lie parks should be established to enable the full use of such parks and playground in a safe manner; NOW THEREFORE: BE IT ORDAINED BY THE CITY COlJNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 19B entitled 11Parks11 of the Code of Ordin- ances of the City of Lubbock be and the same is hereby amended by adding Sec ... tions thereto which shall read as follows. to .. wit: SECTION 19B ... 6. Unlawful Activities Within Parks. It shall be unlawful for any pe;-son within a public park or playground to commit or do any of the following acts: 1. To play at any game of baseball.. softball,. football., golf, archery or other games of like character in any park or play- ground except at the places set apart and designated as grounds therefor. 2. To place and/ or operate any boat, raft or a ther water craft capable of being occupied by one or more persons,. whether motor powered or not, in or on the waters of any pool, lake or river in any park within the City except at the places set apart and ~esignated therefor. 3. To swim, bathe, or wade in any waters, pool. lake or river in any park within the City except at the places set apart and designated as grounds therefor. 4. To fish in any waters, pool, lake 0 r river in any park within the city except at the places set apart and designated therefor and in compliance with the rules and regulations established therefor. 5. To camp in any park within the City except at the places set apart and designated as grounds therefor. 6. To ride, drive or propel any bicycle.t motorbike or motor scooter over or through any park within the City except along or upon park drives,_ pa;rkways or park boulevards. This exception shall not apply to Meadowbrook Municipal Golf Course as such acts are prohibited therein in Section 26-20 of this Code and this Section shall be cumulative to said Section 26-20. 7. To fly any model airplane~ either by attached or remote control,. in any park or playground within the City except at the places set apart and designated as grounds therefor. SECTION 19B-7. Penalty for Violation. Any person who shall violate or fail to comply with any of the provisions of the above Section shall be deem guilty of a misdemeanor and upon a conviction thereof shall be punished by a fine in any amount not to exceed $200. oo. SECTION 19B-8. Powers and Duties of Director of Parks. Subject to the approval of the City Council, the Director of Parks and Recreation, with the recommendation and approval of the Parks and Recreation Board, is hereby authorized and empowered to prescribe rules and regulations to promote the orderly use of all such parks and playgrounds including the designation of areas where the acts and activities it? the Sections above may be permitted and is further empowered to regulate such activities in areas where they are permitted when it is necessary to conttol such activity for public safety to prevent congestion or to secure the maximum use of such public park or playground for the comfort and convenience of the public. SECTION 2. Should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby directed to cause publica- tion of the descriptive caption of this Ordinance together with the penalty clause as alternative method previded by law.
