AN ORDINANCE AMENDING z,orn1"lu vn.LJ.1..a.~ ..... ~-1CE NO.' 169 5 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWIN CHANGE: ZONE CASE N<i) 1131-A; CHANGE A TRACT OF LAND OUT OF SEC TION 7~ BLOCK E-2.,_ LUBBOCK COUNTY.,· TEXAS,_·· FROM AN "R-111 AND "R-3' TO A ''C-311 ZONING DISTRICT, SUBJECT TO CONDITIONS. WHEREAS~ the proposed change in zoning districts as hereinafter made has been duly presented to the zoning and planning commission for its recommen dation which was received by the City Council and after due consideration., the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and., WHEREAS,. all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with., as well as giving notices in compliance with Section 20 of Ordinance No. 1695., as well as notices provided by Article 1011f, Vernon1s Annotated Civil Statutes amended in 19 61, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15} days prior to the date of the public hearing before the City Council on such proposed amendment., and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall.,. Lubbock, Texas~ at which time persons appeared in support of the proposal; and., after said hearing_. it was by the City Council determined that it would be in the public interest due to changed conditionsa-that the Zoning Ordinance and the Zo · Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 169 5 and the Official _Zoning Map BE and the same are hereby amended as follows., to-wit;' ZONE CASE 1131-A Change a tract of .-Thnd out of Section 7:. Block E-2, Lubbock County., Texas~ from an ''.R-111 and "R-311 to a 11C-311 Zoning District. Property is further described by metes and bounds to-wit: BEGINNING at a point which is 501· east and 7 51 south of the northwest corner of Section'i1., Block E-2., said point being the intersection of the south line of 50th Street and the east line of Indiana Ave. THENCE South 89° 461 5011 east, with the South line of 50th Street., approximately 1217. 711 to a point in the west line of Gary Avenue; I ' . THENCE South 03° 451: 20n east., with the west line of Gary Avenue. approximately 598. 55t to a point "in the north line of an alley. THENCE West, with the north line of an alley., approximately 4700 831; THENCE South 45° west, with the northwest line of an alley., approximately 215. 68t; THENCE West, with the north line of an alley., approximately 639. 051 to a point in the east line of Indiana Avenue; THENCE North o0 01 r 1011 east, with the east line of Indiana Avenue., approximately 755.14" to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the fourteen (14) uses., listed on the site plan as exclusions or deletions from 11C-311 classifications., shall be and are hereby excluded and deleted as uses permitted and applicable to this tract of land. 2. That prior to or concurrently with the construction of the first building., a screening fence shall be erected along the full length of the south property line of this tract and shall be a solid decora- tive type screening fence, a minimum of st in height, of a perma ... nent type construction, excluding concrete blocks., .and is to be permanently maintained in good condition by the owners of this tract. 3. That the light standards for the south parking lot shall not exceed ai: in height and be installed in such manner as to prevent glare and reflection on the residential property south of the East/West Alley abutting this tract. 4. That all buildings be limited to single story. 5. That no signs along the south or 11rearn frontage shall be installed which extend above the height of the building. 6. That the ingress and egress for all driveway locations shall be as shown on the site plan. 7. That all service station facilities and related uses shall be restricted from all the area within the site plan except that por- tion thereof at 50th Street and Gary Avenue designated on the approved site plan as a tire, battery and accessory commercial. retail store. ' j:B:EW 8,. That the alley along. the south property line from Gary Avenue to Indiana Avenue, and the 11spur11 alley extending southwest to 53rd Street between Lots 286 and 287 of the Leftwich ... Monterey Addition to the City of Lubbock shall be paved prior to or con.,. currently with the construction of the first building. 9. That the portion of the area not devoted to building or building sites within the site plan shall be paved and/or landscaped in a manner to conform with the development of the entire area to pro ... vide and permanently maintain a motor vehicle parking area with not less than a ratio of three (3} to one (1). 10. That all proposed landscaping be provided along with initial development of the property and permanently maintained by the owners of this tract. 11. That all signs be restricted to a center identification and individual businesses at such place as designated on the site plan. SECTION 2. THAT the site plan referred to in Section 1 hereof under 11Conditions II is attached hereto and made a part hereof and is hereby in all things approved and adopted.
