AUG 18 1981 sMH:pc ,..., -~~·~• f-I ?>·11 ORDINANCE NO. 8214 AN ORDINANCE AMENDING ORDINANCE NO. 7084 AMENDING SECTION 22.3-2 ENTITLED TOWNHOUSES; R-2 TWO FAMILY DISTRICT TO PERMIT TOWNHOUSES CLAUSE AND PROVIDING FOR PUBLICATION. (BEING THE ZONING ORDINANCE), BYj BY AMENDING SECTION 7.3 ENTITLED j IN R-2 ZONES; PROVIDING A SAVINGS] WHEREAS, the proposed change in the zoning ordinance has been recommended by the Planning and Zoning Commission; and WHEREAS, the City Council has found that the changes indicated below would be in the best interest of the citizens of the City of Lubbock, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 22.3-2 of Ordinance 7084 (being the Zoning Ordinance), BE and is hereby amended by amending Section 22.3-2 to read as follows: "22.3-2 TOWNHOUSES -(Single Family Attached Dwellings} In the 'R-1' Districts provided the following requirements are met: 22.3-2-1 Land is platted for townhouses with such plat covering all land area having continuous common street frontage and located I on one side of a street, between intersecting street; designati g individual lots including the end units for a given structure as well as any common ownership areas which may be provided or required. 22.3-2-2 Common areas, where provided, shall be under the control and jurisdiction of a homeowner's association. 22.3-2-3 No structure has less than two (2) dwelling units or an overall length exceeding two hundred and fifty (250) feet. 22.3-2-4 The minimum front yard shall be fifteen (15) feet, provided that in no case shall a garage or carport fronting onto a street be within twenty (20) feet of the street property line. 22.3-2-5 The minimum rear yard shall be five (5) feet for any single story structure, and fifteen (15) feet for any second.story. If access is from an alley, the minimum setback will be fifteen (15) feet for garages, or five (5) feet for carports. 22.3-2-6 The minimum side yard shall be zero (O) feet; however, there shall be at least ten (10) feet separation between buildings. There shall be a minimum of ten (10) feet from any street property line except that in no event shall a residential garage be less than twenty (20) feet from any street property line. 22.3-2-7 The minimum lot frontage for each individual townhouse unit shall be twenty (20) feet. 22.3-2-8 The minimum lot area for each individual townhouse unit shall be two thousand (2,000) feet. 22.3-2-9 The maximum individual lot coverage shall be sixty-five (65) percent. 22.3-2-10 The maximum density shall be the same as the zoning district in which the townhouses are built. 22.3-2-11 The height shall not exceed the height permitted in the zone district in which the townhouses are built. 22.3-2-12 Off-street parking shall be provided as follows: Two (2) spaces per unit. 22.3-2-13 In addition to any required landscaping for common areas, the front yard and parkway areas shall be landscaped and permanently maintained. 22.3-2-14 If lots do not front on a public street, they shall front onto an access easement that has access to a public street. The access easement shall meet width requirements of applicable public street standards set forth in the Subdivision Ordinance. 22.3-2-15 After property is platted, as required in Section 22.3-2- 1, permits for individual townhouses may be issued." SECTION 2. THAT Section 7.3 of Ordinance 7084 (being the Zoning Ordinance) BE and is hereby amended by adding 7.3-3 to read as follows: "7.3-3 Townhouses. (Subject to the requirements of Section 22.3-2).11 SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
