AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 1968-B;
CHANGE PART OF TRACT C, RUSHLAND PARK ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY,
TEXAS FROM C-2 TO C-3 ZONING DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED FOR
IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the City
Council finds that due to changed conditions, it would be expedient and in the
interest of the public health, morals, and general welfare to make those
proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 26 of Ordinance No. 7084, as well as
notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended
in 1961, and notice was duly published in the Lubbock Morning Avalanche-
Journal more than fifteen (15) days prior to the date of the public hearing
before the City Council on such proposed amendment, and the public hearing
according to said notice was duly held in the City Council Room on the second
floor of the City Hall, Lubbock, Texas, at which time persons appeared in
support of the proposal; and, after said hearing, it was by the City Council
determined that it would be in the public interest, due to changed conditions,
that the Zoning Ordinance and the Zoning Map be amended in the manner here-
inafter set forth in the body of this Ordinance and this Ordinance having been
introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 1968-B
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map Be
and the same are hereby amended as follows, to-wit:
Change part of Tract C, Rushland Park Addition, City of Lubbock, Lubbock
County, Texas from C-2 to C-3 zoning district. This property is further
described by metes and bounds as follows:
BEGINNING at a point which bears East a distance of 399.41 feet and South
a distance of 12.00 feet from the original Northwest comer of Tract 11C",
15th Installment, Rushland Park Addition to the City of Lubbock, Lubbock
County, Texas;
THENCE N. 89°49'36" E. a distance of 169.91 feet to a point of curvature;
THENCE Southeasterly around a curve to the right, said curve having a
radius of 30.00 feet, a central angle of 90°10'2411 , tangent lengths of
30.09 feet, and a chord distance of 42.49 feet;
THENCE South a distance of 171.33 feet;
THENCE West a distance of 199.92 feet;
THENCE North a distance of 200.74 feet to-the-Point of Beginning.

SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars
as provided in Section 1-5 of the City Code.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.

Request of Burl W. Masters {for State Savings and Loan Association) to change part
of Tract C, Rushland Park Addition, Cit of Lubbock, from C-2 to C-3 Zonin District
located at th Street and Quaker Avenue •
The Planning and Zoning Commission recommended that this request be approved.
The motion was made by Mayor Pro Te,m Henry, seconded by Councilman Brown to approve
Ofdinance No. 8213 on first reading, approving C•3 zoning limited to the self-service
gasoline station and automatic bank teller insta11atlon WrTH THE UNDERSTANDING that
p~ior tohthe second reading, a site plan and/or~an elevation ~as t6 be submitted; that
'the staff poll the members of the Zoning Board of Adjustment to ascertain the possit.Jllty
of holding a special meeting to consider the request for a variance as tied to a site
plan, said request being initiated by the City of Lubbock at no cost to,the proponent,
al;lowing this particular use in this area~ fn the event the Z.BA is unable to consider
, this matter in timely fashion, that the request should be considered for second and
fi\lal reading on August 13, 1981, sub)ect to a site plan being submitted; that In the
event the ZBA does meet In a Special Session:andapprove the request as stated, the

**,*On'September 10, 1981, I talked with 1Jerre1 Northcutt, Zoning Administrator, to check·
on the status of this Zone Case. He responded that the Zone Case had gone to lBA and
therefore would not have to come before Council; so to consider this particular Zone
Case withdrawn.
