AN ORDINANCE CANVASSING THE RETURNS AND DECLARING
THE RESULTS OF AN ELECTION HELD IN THE CITY OF LUBBOCK.,
TEXAS., ON JANUARY 24TH., 1967., PURSUANT TO ORDINANCE NO. 5176
CALLING FOR A SPECIAL ELECTION ON CERTAIN PROPOSED AMEND
MENTS TO THE CHARTER OF THE CITY OF LUBBOCK~ TEXAS AS
SUBMITTED AND :V:OI'ED ON BY THE QUALIFIED ELECTORS OF THE
CITY OF LUBBOCK.

WHEREAS,. by virtue of Ordinance No. 517 6., duly passed by the
City Commission of the City of Lubbock., Texas., on the 24th day of
December., 19 66., propositions ,to amend the Charter of the City of Lubbock
were submitted by ballot to the qualified voters of the City of Lubbock on
January 24th., 1967., after due notice pursuant Section 1., Article 1170.,
Revised Civil statutes of Texas., 1925., as amended py the 57th Legislature
of the State of Texas., published in accordance with and as directed herein,.
and
WHEREAS-1 said proposed amendments are set out in full in Ordinan e
No. 5176., pursuant to which ordinance saidpr.oposed amendments were
submitted for consideration by the electorate of the City of Lubbock; and
WHEREAS.,. as directed and in compliance with Chapter 1., Article
Section 6., of the Charter of the City of Lubbock and the laws of the State
of Texas the returns of the Special Charter Amendment Election held
January 24th., 19 67., should be opened and canvassed and the results there
declared;· and
WHEREAS,. upon consideration of the returns of said election., it ap
ears that the same was in all respects legally held., after due notice had
been given., that said returns were duly and legally made and properly
reflect the results of said election on all propositions submitted., NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL CF THE CITY OF LUBBOCK:
SECTION 1 : THAT there was submitted to the qualified voters of
the City of Lubbock., Texas., on January 24th., 1967., in accordance with th
law for the purpose of passing on the question of adopting amendments to
the Charter of the City of Lubbock., Texas. the question reading as follow :
Amendment No. 1
Do you vote to amend the present City Charter of the City of Lubboc .,
Texas. by eliminating altogether the annual appropriation for support of

the board of City Development?
Amendment No. 2

Do you vote to amend the present City Charter of the City of Lubbock.,
Texas., by repealing Section 3a., Chapter 1., Article 1., and amending Section
3., Chapter 1., Article 1, so as to allow annexation by the City in the manner
provided by the Municipal Annexation Act of the State of Texas?

SECTION 2. THAT the qualified voters voted on said question at the

polls and cast their ballots and answered the foregoing questions as
follows:
On Amendment No. l, 4311 votes answered YES, and M.2..§.VOtes answered'' O.
On Amendment No. 2., 6463 votes answered YES, and2275 votes answered -.-
On Amendment No. 3., 5649 votes answered YES,. and2888 votes answered
On Amendment No. 4,, 5720 votes answered YES., and2920 votes answered
On~Amendment-':No. 5, 7006votes answered YES., and 1708votes answered
THAT there were only 9137 votes in all cast at said election and that
a majority thereof was cast in the negative in answer to amendment No. l
and that a majority thereof was cast in the affirmathze in answer to each
of amendments No. 2 through 5.
SECTION 3. THAT ::the aforesaid election was duly and legally called
and notice thereof given in accordance with the laws of the State of Texas
and the Ordinance calling said election; and that said election was held i
strict conformity with the Constituti'on and the laws of the State of Texas.,
and the returns thereof have been properly made to the officials of the c· y
entitled to receive the same; and further that said election properly repr -
sents the desires of those qualified to vote therein and the City Commiss on
has duly canvassed the election returns and find that a majority of the
qualified voters do not favor the adoption for amendment No. 1,, and tha
said amendment has been legally rejected,, and that a majori't:;y,. of the
qualified voters do favor the adoption of Amendments No. 2 through 5,,
aforesaid and that they have legally carried,, been adopted and approved.
SECTION 4(a). THAT it is ordered that said proposed amendment No.
be considered as disap_proved and rejected and it is therefore ordered th t
same be hereby a.eclared to be disapproved and rejected by the voters of
the City of Lubbock. {b) It is ordered that said proposed amendments 2
through 5., be and the same are hereby approved and adopted and made a art
of the Charter of the City of Lubbock,, Texas; and that a copy of said Ord
inance orderirig~~ the said election to·w"it number 5176 as well as this
Ordinance be recorded in full in the proper records of the City of Lubboc .
SECTION 5. It is further ordered that the Amendments No.2 through
5 which are hereby approved and adopted and made a part of the Charter
of the City of Lubbock shall become effective and be in full force and
effect from the date of the final approval and adoption of this Ordinance.
