HomeMy WebLinkAboutOrdinance - 5096-1966 - Amending Zoning Ordinance 1695 Zone Case 1437 Apartment Development - 09/22/1966I u ORDINANCE NO.-5096 _______ AN ORDINANCE AMEl'fQINq ZONING ORDINANCE No.· 1695 AND THE OFFICIAL MAP OF THE CITY'OF LUBBOCK SO AS TO MAKE THE FOLLOWIN CHANGE: ZONE CASE NO:.: 1437: CHANGE A TRACT OF LAND OUT OF SECTION 22., BLOCK A., LUBBOCK COUNTY., TEXAS, FROM 11R-l II TO "R-311 ZONING DISTRICT LIMITED TO APARTMENT DEVELOPMENT ONLY; SUB- JECT TO CONDITIONS. I WHEREAS. the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its r ecom- mendation, which was received by the City Council and after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in. the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendme t to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article l0llf, Vernon.rs Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15), days prior to the date of the public hearing before the City Counc 1 on such proposed amendment, and the public hearing according to said notice wa duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing. it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. i 143 7 Change a tract of land out of Section 22, Block A, Lubbock County, Texas, from 11R-l 11 to "R-311 Zoning District limited to apartment development only. Property is further described by metes and bounds, to-wit: BEGINNING at a point in the north line of 4th Street which is 60' north and 2308. 6' east of the southwest corner of Section 22, Block A; THENCE North a distance of 3184. 7' to a point inthe south right- of .. way line of Loop 289; THENCE Northeasterly along the south right-of-way line of Loop 289 a distance of 1386. 1' to a point; THENCE South a distance of 3472. 4' to a point; THENCE West a distanc~ of 8001 to a point; THENCE South a distance of 545' to a point in the north line of 4th Street; THENCE West a distance of 308. 1 1 to the PLACE OF BEGINNING.· SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the development be limited to apartments only. 2. That a minimum of 1500 square feet of lot area be provided for each apartment unit. 3. That 1 1 /2 paved off--street parking spaces be provided for each 1 bedroom apartment unit and that 2 such spaces be pro .. vided for each 2 or more bedroom apartment units. SECTION 2. THAT from and after passage and effective date of this Ordinance, said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. AND IT IS SO ORDERED., Passed by the City Council on first reading this 22nd day of September , 1966.
