HomeMy WebLinkAboutOrdinance - 9449-1991 - Amending Ch 6 City Electrical Code 1990 Edition - 05/23/1991II i ~; ~ i i DGV:da First 'Reading· May 23, 1991 Item #25 Second Reading June 13, 1991 Item #9 ORDINANCE NO. 9449 AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK WITH REGARD TO THE CITY OF LUBBOCK ELECTRICAL CODE; PROVIDING FOR ADOPTION OF THE 1990 EDITION OF THE NATIONAL ELECTRICAL CODE; PROVIDING FOR DELETION OF SUBSECTION 300-4(D) FROM SUCH CODE; PROVIDING FOR AMENDMENT OF SECTIONS 6-153, 6-158, 6-159, 6-228 AND 6-260 OF SUCH CODE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to adopt the 1990 Edition of the National Electrical Code, with slight modification, for use in the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 6-141 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: Sec. 6-141. National Electrical Code adopted by reference. The book ent;tled "National Electrical Code," 1990 Edition (NFPA No. 70-1990), (a copy of which, authenticated by signature of the building official, shall be filed with the City Secretary as a public record) is hereby adopted as a part of this Code as if fully copied at length in this section. In the event of a conflict between any provision of the ".National Electrical Code" and the Code of Ordinances, the Code·of Ordinances shall control. References in the Code of Ordinances to the National Electrical Code shall mean the 1990 Edition. SECTION 2. THAT Section 6-153 of the Code of Ordinances of the City of lubbock, Texas, is hereby amended to read as follows: Sec. 6-153. License or certificate of registration from other cities. A master electrician, master sign electrician, journeyman electrician, or journeyman sign electrician licensed to perform electrical work in other cities for at least three (3) years preceding application to the City of Lubbock may apply for and receive a license similar or equivalent to his curretlt license without taking the required examination under the'following conditions: (1) He shall submit evidence satisfactory to a majority of the board that his current license was issued by a city operating under the "National Electrical II I I I (2) (3) Code," currently adopted edition (See section 6- 141), or later edition of said code. He shall submit evidence satisfactory to a majority of the board that his current license was issued under conditions not less restrictive than required by this code for issuance of such a license. He shall submit evidence satisfactory to a majority of the board that an electrician licensed by the board would be permitted to apply for and receive a similar or equivalent license under reciprocal conditions from the city issuing applicant's current licenses. (4) He shall furnish all necessary certificates of insurance, pay all license fees and comply with all other requirements of this code. (5) A license issued under this section may be revoked or suspended for any of the reasons set forth in section 2-456 of the Code of Ordinances of the City of Lubbock. The three (3) year requirement stated above may be waived by the board providing the reciprocating city has no three (3) year requirement for reciprocity. SECTION 3. THAT Subsection 6-158(1) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (1) He shall be a high school graduate or the equivalent thereof and shall have two (2) years of apprentice level experience and two (2) years of journeyman sign level experience under a master sign electrician or equivalent in electrical construction; or SECTION 4. THAT Subsection 6-159(b)(2) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (2) He shall have completed two (2) years experience as an apprentice working under the supervision of a licensed master sign electrician; and SECTION 5. THAT Subsection 6-228(11) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (11) No governmental entity shall be exempt from payment of electrical permit fees unless such entity is specifically exempted by state or federal law. Exception: no fee shall be required from a governmental entity when the work is being - 2 - I il 1: 1: i! I' performed by licensed maintenance personnel employ~d full-time by the governmental entity on buildings owned and occupied by the governmental entity. However, permits and inspections shall be required in all instances. SECTION 6. THAT Section 6-250 of the Code of Ordinances of the City of lubbock, Texas, is hereby amended to read as follows: Sec. 6-250. Cables and raceways parallel to framing members. Subsection 300-4(d) of Chapter 3 of the National Electrical Code is hereby deleted from the City of lubbock Electrical Code. SECTION 7. THAT Section 6-260 of the Code of Ordinances of the City of lubbock, Texas, is hereby amended to read as follows: Sec. 6-260. Fixtures in clothes closets. Section 410-8 of Chapter 4 of the National Electrical Code is hereby amended to read as follows: 410-8. Fixtures in Clothes Closets. (a) Location. A fixture in a clothes closet shall be permitted to be installed: (1) On the wall above the closet door, provided the clearance between the fixture and a storage area where combustible material may be stored within the closet is not less than 18 inches (457 mm), or (2) On the ceiling over an area which is unobstructed to the floor, maintaining an 18-inch (457 mm) clearance, horizontally, between the fixture and a storage area where combustible material may be stored within the closet. A flush recessed fixture with a solid lens or a ceiling mounted fluorescent fixture shall be permitted to be installed provided there is a 6-inch (152 mm) clearance, horizontally, between the fixture and the storage area. Where the minimum clearance provided above cannot be obtained, it shall be permissible to reduce the horizontal clearance to a minimum of 6 inches (152 mm) from the edge of the fixture to the edge of a shelf located above the hanging clothes, if the shelf is at least 12 inches (304 mm) wide and if a horizontal - 3 - clearance of 2 inches (51 mm) is maintained between the edge of the fixture and the opposite wall. (b) Pendants. Pendants shall not be installed in clothes closets. SECTION 8. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 9. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
