August 23, 1990 Item #19 Second Reading September 13, 199 Item #9 ORDINANCE NO. 9380 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 ANO THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2653; A ZONING CHANGE FROM M-1 TO M-2 ZONING ON A TRACT OF LAND OUT OF BLOCKS 84, 85 AND 95, WHEELOCK'S SECOND ADDITION, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those pro- posed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giv- ing notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, as well as notices provided by Section 211.007(c), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche- ! Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council deter- mined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been intro- duced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2653 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from M-1 to M-2 zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract of land out of Blocks 84, 85 and 95, Wheelock's Second Addition, City of Lubbock, Lubbock County, Texas, located at approximate 719 E. 34th Street and being further described as follows: A tract of land located in Blocks 84, 85 and 95, and abandoned streets adjacent thereto, of Wheelock's Second Addition to the City of Lubbock, Lubbock County, Texas; BEGINNING at a 1/2" square tube found in the North line of 34th Street which bears North a distance of 71.99 feet and East a distance of 2308.90 feet from the Southwest corner of Section 5, Block 8, Lubbock, Lubbock County, Texas; THENCE North, along the East line of the railroad right-of-way, a dis- tance of 372.00 feet to a 1/2" iron rod with cap set for an ell corner of this tract; THENCE S. 89°52'30 11 W., along said railroad right-of-way, a distance of 2.92 feet to a 1/2" iron rod with cap set for the most Westerly corner of this tract; THENCE N. 08°19'46" E., along said railroad right-of-way, a distance of 180.93 feet to a 1/2" square tube found at a point of curvature; THENCE Northeasterly, along said railroad right-of-way, around a curve to the right, said curve having a radius of 430.68 feet, a central angel of 71°01'55", tangent lengths of 307.38 feet, a chord distance of 500.39 feet, and an arc length of 833.93 feet to a point in the South right-of-way line of F.W. & 0. R.R.; THENCE S. 71°37'10" E., along the South line of said railroad right-of- way, a distance of 45.31 feet to a 1/2" iron rod with cap set for the most Easterly Northeast corner of this tract; THENCE South a distance of 769.45 feet to a 1/2" iron rod with cap set for the most Easterly Southeast corner of this tract; THENCE S. 89°52'30 11 W., a distance of 67.08 feet to a 1/2" iron rod with cap set for an ell corner of this tract; THENCE South a distance of 140.00 feet to a 1/211 iron rod with cap set in the said North line of 34th Street for the most Southerly Southeast corner of this tract; THENCE s. 89°52'30 11 W., along said North line of 34th Street, a distance of 326.77 feet to the POINT OF BEGINNING. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - SECTION 4. THAT the City Secretary is hereby authorized to cause publi- cation of the descriptive caption of this Ordinance as an alternative method provided by law. ANO IT IS SO ORDERED.
