Zone Case 1429-H Delete Conditions 5412, 5814 - 12/10/1987BLL:js First Reading December 10, 1987 Item #10 Second Reading December 17, 1987 Item #10 ORDINANCE NO. 9154 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1429-H; DELETE CONDITIONS OF ORDINANCE 5412 AND 5814 ON TRACT I, SOUTH UNIVERSITY ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PRO- VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Section 211.007(c), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1429-H SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: That Ordinance 5412 and 5814 are hereby amended by deleting those con- ditions on Tract I, South University Addition to the City of Lubbock, Lubbock County, Texas, located at 2315 66th Street and being subject to conditions. SUBJECT TO THE FOLLOWING CONDITIONS: a. That the zoning uses granted shall be limited to the existing building only, and the zoning district shall be C-4 limited to the following uses: (1) Barber and beauty shop supply dealer. . i (2) Builders supply. All materials must be in building. (3) Cafe supply dealer, fixtures. (4) Candy plant. (5) Canvas goods shop, tents and awnings (no manufacturing). (6) Dairy supply dealer. (7) Electrical equipment repairs. (8) Feed store with no grinding, packaging, or mixing of feed permitted. (9) Frozen food lockers. (10) Furniture store, used. (All merchandise must be in a building.) (11) Garden center. (12) Janitorial or cleaning service. (13) Job printing and lithographing. (14) Laboratory, chemical, general analysis. (15} Laundry, commercial. (16) Linen and towel supply service. (17) Magazine agency. (18) Nonprofit training centers with retail sales. (19) Pest control service. (20) Print shop. (21} Produce market. (22) Public kennel (totally within a building}. (23) Rental store. (24) Restaurants. (Business permitted outside of building.) (25) Restaurants, with the sale of alcoholic beverages as in incidental use, except that no mixed alcoholic beverage sales shall be made or delivered to occupants in motor vehicles. - 2 - ' i (26) Sign shops, limited to window lettering, painted wall signs, banners and desk signs. (27) Store fixtures sales (no manufacturing permitted). (28) Upholstery shop--Furniture. (29) Veterinary hospital (totally within a building). (30) Wholesale house, sales office and storage--No cotton storage. (31) All unconditionally permitted C-3 uses. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
