WHEREAS, the City Council has determined that the changes hereinafter
made are to the benefit of the public health, safety and general welfare and
are in the best interest of the citizens of Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Chapter 6, Article II of the Code of Ordinances, City
of Lubbock, Texas, is hereby amended to read as follows:
Sec. 6-55.1. §3802. Sprinkler Systems.
Subsection (g) of Section 3802 of Chapter 38 of the Uniform
Building Code is amended by adding the following exception:
3. Notwithstanding the requirements of Section 3802(9) of the
Uniform Building Code a structure used as a jail for the
confinement of prisoners or juvenile detention center
shall not be required to have an automatic sprinkler sys-
tem provided the following conditions are met:
a. The governmental entity which is to build or con-
struct such jail or detention facility in writing
agrees to hold the City of Lubbock harmless from all
suits, claims and cause of action in any way or man-
ner arising from the lack of a sprinker system in
said facility.
b. In the case of a jail, the Texas Commission on Jail
Standards has reviewed the plans for the construc-
tion of the proposed jail and has indicated in writ-
ing that they do not advocate the use of sprinklers
in the proposed jail facility. In the case of a ju-
venile detention center, the appropriate agency of
the State of Texas has reviewed the plans for the
construction of the proposed detention center and
has indicated in writing that they do not advocate
the use of sprinklers in the proposed facility.
c. And in addition to a. and b. above the jail shall
have all of the following systems:
1. Intercommunications system;

2. Monitored Television;
3. Approved Fire Alarm System;
4. On Duty Floor Officers;
5. Non-Combustible Construction 1-FR;
6. Smoke Evacuation System;
7. Prisoner Direction Supervision; and
8. Class III Standpipe System.
4. In jails and juvenile detention centers where the correct
number of exits and the required distance to exits cannot
be provided, compartmentation and areas of refuge shall be
provided.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed Two Hundred
Dollars ($200.00) as provided in Section 6-20 of the Building Code of the
City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
