AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY·
OF LUBBOCK, TEXAS, WITH REGARD TO ELECTIONS FOR MUNICIPAL OFFICERS TO
CONFORM TO THE TEXAS ELECTION CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION.
WHEREAS, the 70th Legislature of the State of Texas at its Second
Called Session enacted House Bill No. 28 which changes uniform election
dates and runoff election dates available to home rule cities within the
State of Texas; and
WHEREAS, said provisions of law require designation of dates by
municipal governing bodies and supersede city charter provisions conflicting
with such changes; and
WHEREAS, the City Council of the City of Lubbock believes that it
would be in the best interest of the citizens of the City of Lubbock to
indicate by ordinance when the City of Lubbock's general elections of
municipal officers and any required runoff elections are to be held; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Sections 8-1, 8-2 and 8-3 of the Code of Ordinances
of the City of Lubbock, Texas, BE and are hereby amended to read as follows:
Sec. 8-1. Regular municipal election.
The regular municipal election for the election of
municipal officers of the City of Lubbock shall be held on the
first Saturday of May of every even numbered year in accordance
with the applicable provisions of the Texas Election Code.
Sec. 8-2. Runoff election.
Where in any regular municipal election no candidate
receives a majority of all of the votes cast for such office at
such election, the City Council shall, immediately upon
declaring the official results of such election, call a runoff
election for every office to which no one was elected. Such
runoff election shall be held on the 1ast ·
Saturday of May, unless another day ii.stated in fhe order
calling the runoff election, and in such runoff election the two
candidates who received in the preceding election the highest
number of votes for each office to which no one was elected
shall be voted on again and the candidate who receives the
majority of the votes cast for such office in the runoff
election shall be declared elected to such office.
Sec. 8-3. State election laws controlling.
All elections shall be conducted and the results canvassed
and announced by City of Lubbock authorities as prescribed by
the election laws of the State of Texas.
SECTION 2. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized and directed
to cause publication of the descriptive caption of this Ordinance as an
alternative method of publication provided by law.
AND IT IS SO ORDERED.
