HomeMy WebLinkAboutOrdinance - 8120-1980 - Amending Zone Ord #7084 And Lubbock Official Map For Changes Zone Case #2301 - 12/11/1980I! r I SMT:cl ORDINANCE N0. __ 81_2_0 _____ _ I AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF I THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2301: CHANGE THE EAST 50 FEET OF LOTS 1 THROUGH 6, BLOCK 147, ORIGINAL TOWN ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM C-4 TO C-4 (DR) ZONING DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the building is of interest as a prominent part of early develop- ment in downtown Lubbock. Built in 1928 in the Original Town, this commercial building was continuously in use for more than 50 years. Furniture dealers, office supply, and the USO have occupied the structure during its existence; and ·WHEREAS, characteristic of one of many dynamic, enterprising business persons associated with the early years of Lubbock, Norton Baker represents an example of the keen interest of the citizens of early Lubbock who created an aggressive business climate that persists today, as well as showing respect for the value and beauty of the built environment; and WHEREAS, the building was constructed by J.B. Maxey, a prominent con- tractor in early Lubbock. Some of the other structures on which J.B. Maxey was the builder were St. Paul of the Plains Episcopal Church, K. Carter School, the First National Bank Building, and the President's home on the Texas Tech campus and WHEREAS, as redevelopment of the central business district continues, distinct structures such as the Baker Building will become the nucleus for adaptive or continuous use of the building stock in downtown Lubbock. Such examples are necessary to attract and encourage other such activities; and WHEREAS, the Urban Design and Historic Preservation Commission for the City of Lubbock is of the opinion that the Baker Building, 1211 13th Street, should be preserved as part of our heritage for future generations and that the Baker Building owner and tenants should be recognized for their fine work in preserving that building by making it a historic landmark of the City of Lubbock; and WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided in Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the pro- posal; and, after said hearing, it was by the City Council determined that it ,. ' . . ! t • would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in.the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2301 SECTION 1. THAT the east half of lots 1, 2, 3, 4, 5, and 6, Block 147, Original Town Addition of Lubbock, Lubbock County, Texas, BE and is hereby changed from C4 to C4 (DH) zoning district, and. is declared to be a historic landmark district. I i SECTION 2. THAT the main building locatedJ on the lot described in Section 1 herein BE, and is hereby declared to be a historic landmark. SECTION 3. THAT any new buildings or strultures within this district shall be architecturally compatible with the historic landmark structure there- in, in terms of style, color, materials, texture, and basic form as found in the Spanish Renaissance, Mission, or Spanish Colonial styles as described in the booklet, "Architecture in Lubbock: A Guide for Identification and Preserva- tion," first edition, 1979. SECTION 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: a. the exterior walls and roof, b. the enriched compound arch doorway flanked by pilasters with ornate capitals, c. the center window with a broken scroll pediment and a curvilinear gable, d. the ornamental red tile coping, e. the arched window openings on the second floor, enhanced by molded banderol columns and iron balconettes, f. the small decorative flower-like paterae at various locations on the second floor, SECTION 5. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shall be used. to indicate the degree of alteration which has already occured and the degree of preservation of the original structure. These photographs shall be identified as follows: No. 1: General front view from the north. No. 2: General front and east side view from the northeast. No. 3: Close view of front entrance from the north. No. 4: Close view of broken scroll pediment and a curvilinear gable. •, fl No. 5: Close view of second floor detail from the northeast. No. 6: Close view of door pilasters. SECTION 6. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary is hereby authorized to cause publica- tion of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
