HomeMy WebLinkAboutOrdinance - 9134-1987 - Amending Zoning Ordinance 7084 Zone Case 1895-B - 10/22/1987BLL:js First Reading October 22, 1987 Agenda Item #10 Second Reading November 12, 1987 Agenda Item #7 ORDINANCE NO. 9134 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1895-B; ZONING CHANGE FROM C-2 TO C-3 ZONING ON TRACTS OUT OF SECTION 10 AND 11, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PRO- VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Section 211.007(c), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1895-B SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from C-2 to C-3 zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on tracts out of Section 10 and 11, Block E-2, City of Lubbock, Lubbock County, Texas, located at Loop 289 and Quaker Avenue and subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a 346,302.00 square feet tract located tn Section 10 and 11, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a found 1/2" iron rod which bears N. 00°02 146" E. a dis- tance of 441.54 feet and S. 89°57 1 1411 E. a distance of 142.96 feet from the Southwest corner of the Northwest Quarter of Section 11, same being the Southeast corner of the Northeast Quarter of Section 10, Block E-2, Lubbock County, Texas; THENCE N. 89°57 114" W., a distance of 142.96 feet past the West line of Section 11 and the East line of Section 10, continuing for a total distance of 440.00 feet to a found 1/2" iron rod; THENCE N. 26°57 114" W., a distance of 385.00 feet to a 5/811 iron rod found at a point of curvature; THENCE Northeasterly around a curve to the right, said curve having a radius of 215.00 feet, a central angle of 135°, tangent lengths of 519.05 feet, and a chord distance of 397.27 feet to a found 3/811 iron rod; THENCE S. 71°57 1 14" E., a distance of 224.83 feet to a point in the East line of Section 10 and the West line of Section 11 to a found 3/8" iron rod; THENCE S. 78°15 141" E., a distance of 145.99 feet to a found 1/211 iron rod; THENCE S. 00°02 146 11 W., a distance of 546.05 feet to the POINT OF BE- GINNING. CONTAINS: 346,302.00 total square feet 332,970.60 net square feet SUBJECT TO THE FOLLOWING CONDITION: a. That a site plan including building elevations, showing mate- rials, color and texture shall be submitted and approved by the Planning and Zoning Commission on each tract under this zone case ordinance prior to the issuance of a building permit. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars {$1,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. - 2 - I SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
