I ~gl) 12.·18-l'lSO ORDINANCE NO. 8113 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BY ADDING A SECTION TO BE NUMBERED 6.4-8, MAKING SERVANTS QUARTERS OR GUEST HOUSES ON A TEN THOUSAND FIVE HUNDRED SQUARE FOOT LOT A CONDITIONAL USE IN AN R-1 ZONE DISTRICT AND AMENDING SECTION 19.12 REGARDING SEPARATION FOR BARS, COCKTAIL LOUNGES, PRIVATE CLUBS, NIGHT CLUBS OR DANCE HALLS; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION AND PROVIDING A PENALTY. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City f Council finds that due to changed conditions, it would be expedient and in the ~ inte~est of the public health, morals, and general welfare to make those I proposed changes in zoning; and I I WHEREAS, all conditions precedent required by law for a valid amendment j to the Zoning Ordinance and Map have been fully complied with, as well as ! giving notices in compliance with Section 26 of Ordinance No. 7084, as well as j' notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-1 Journal more than fifteen (15) days prior to the date of the public hearing t before the City Council on such proposed amendment, and the public hearing I according to said notice was duly held in the City Council Room on the second I floor of the City Hall, Lubbock, Texas, at which time persons appeared in ·1 support of the proposal; and, after said hearing, it was by the City Council :! determined that it would be in the public interest, due to changed conditions, I 1 that the Zoning Ordinance and the Zoning Map be amended in the manner herein-~ after set forth in the body of this Ordinance and this Ordinance having been j I ! I I I I i l I I I introduced prior to first reading hereof; NOW THEREFORE: f, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Zoning Ordinance of the City of Lubbock, texas, is hereby amended by adding a section, to be numbered 6.4-8, which said section reads as follows: "6.4-8 Servants quarters or guest houses on a lot containing ten thousan five hundred (10,500) square feet or more of net development area." SECTION 2. THAT Section 19.12 of the Zoning Ordinance of the City of Lubbock, Texas, is hereby amended to read as follows: "Section 19.12 SEPARATION. Any bar, cocktail lounge, private club, night club or dance hall shall be located a minimum of two hundred (200) feet from any residentially zoned property. (This distance shall be measured in a direct line from the nearest wall of the structure in which the use is located to the residential district line.) No bar, cocktail lounge, private club, night club or dance hall shall be located within six hundred (600) feet of any established bar, lounge, private club, night club or dance hall. (This distance shall be measured in a direct line from front door to front door.) II l, I! SECTION 3. THAT violation of any provisions of this Ordinance l shall be deemed a misdemeanor pun.ishable by a fine not to exceed two 1 ;1 hundred dollars as provided in Section 1-5 of the City Code. il il !II ~~ !I li ' i SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
