Home My WebLink AboutOrdinance - 8110-1980 - Amending Zoning Ord. #7084 And Lubbock Map C Hanges: Zone Case #2303. - 12/11/1980SMT:pc 12.,.1/" I <1 fl> /Z'If-11$0 ORDINANCE NO. __ B_ll_O __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2303: CHANGE A TRACT OF LAND OUT OF SECTION 9, BLOCK J-S, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO A-1 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDNG FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock MOrning Avalanche- Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room .on the second floor of the City Hall, Lubbock, Texas, at which ttme persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2303 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map Be and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 9, Block J-S, City of Lubbock, Lubbock County, Tex~s, from R-1 to A-1 zoning district. This property is further describe~ by metes and bounds as follows: A tract out of Section 9, Block J-S, Lubbock County, Texas, being further described as follow8: I BEGINNING at a point which bears South a distance of 2625.92 feet and West a distance of 1948.01 feet from the Northeast corner of Section 9, Block J-S, Lubbock !county, Texas; THENCE N. 89°59' E. 1 1 an approximate distance of 514.33 feet to a point of curvature; , · ! I THENCE Southeaster~y around a curve to the right, said curve having a radius of 140.15 f~et, a central angle of 36°281 22", tangent lengths of 46.18 feet, and a ~hord distance of 87.72 feet to a point of compound curvature; ·1 I THENCE Southerly around a curve to the right, said curve having a radius of 15.00 feet, a cJntral angle of 89°32'36", tangent lengths of 14.88 feet, and a chord ;!stance of 21.13 feet to a point of reverse curvature; THENCE Southwesterly around a curve to the left, said curve having a radius of 5879.65 feet, a central angle of 04°26'29", tangent lengths of 228.00 feet, and a chord distance of 455.66 feet; THENCE N. 62°33'37" w. an approximate distance of 391.52 feet; THENCE N. 00°01' W. an approximate distance of 246.46 feet to the Point of Beginning. CONTAINS: approximately 4.02 acres SUBJECT TO THE FOLLOWING CONDITION: 1. That it be limited to town house and condomin:i,:t'.mls .•. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
