HomeMy WebLinkAboutOrdinance - 8108-1980 - Ord #9016 Est The Prima Facie Speed Limits On Portions Of Ave H Municipal Dr. - 11/20/1980II l SMT:pc ORDINANCE N0. ___ 8.;_;1;:...:0:..;::8~- AN ORDINANCE AMENDING ORDINANCE NO. 9016 ESTABLISHING THE PRIMA FACIE SPEED LIMITS ON CERTAIN PORTIONS OF AVENUE H AND MUNICIPAL DRIVE, AS HEREINAFTER MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING PLACEMENT OF SIGNS WITH RESPECT THERETO; REPEALING CONFLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; APPLICATION OF THIS ORDINANCE ONLY TO STREETS OR HIGHWAYS NAMED HEREIN; PROVIDING THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock, upon the basis of an engineering and traffic investigation found it necessary to alter prima facie speed limts as established by Article 670ld, Vernon's Annotated Civil Statutes, with the areas and locations named and designated in the body of this Ordinance, all within the corporate limits of the City of Lubbock; WHEREAS, the description of the affected area contained in Ordinance No. 9016 was in error; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the prima facie speed limits on the following streets and highways in the urban district set forth below are hereby altered and changed as hereinafter set forth upon the following described portions of streets and/or highways located within the City of Lubbock, Lubbock County, Texas, to-wit: 1. A 35 MPH speed zone on both sides of Avenue H beginning at 4th Street and extending North to 1st Plaee,.:, 2. A 35 MPH speed zone on both sides of Municipal drive cut-off beginning at 1st ~lace: and extending Northeast to Amarillo Rd. cu ... s .• an. SECTIO~ 2. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 3. THAT all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. · SECTION 4. THE City Manager is hereby authorized and directed to cause the placing and maintenance of such traffic control signals and/or devices and/or signs as shall be necessary to apprise the public of the zones as hereinabove set forth. SECTION 5. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 6. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
