ORDINANCE NO. 8106 ----'=:0..::::..---
AN ORDINANCE AMENDING CHAPTER 24 OF THE CODE OF ORDINANCES, CITY OF
LUBBOCK, TEXAS, ENTITLED "PLUMBING CODE", BY REPEALING THE PRESENT CHAPTER 24
AND IN ITS STEAD ADOPTING THE 1979 EDITION OF THE UNIFORM PLUMBING CODE AS
AMENDED; PROVIDING FOR A PENALTY AS SET FORTH IN SEC. 1-5 OF THIS CODE; PROVIDIN
A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock has found that the
present Plumbing Code of the City of Lubbock has become obsolete and inadequate;
and
WHEREAS, the City Council has received the recommendation of the Plumbing
Board that the attached volume entitled Uniform Plumbing Code, 1979 Edition,
be adopted as the Plumbing Code for the City of Lubbock with the specific
amendments hereinafter set forth; and
WHEREAS, the City Council of the City of Lubbock has determined that it
is in the best interest of the City to adopt such Code as amended; NOW THERE-
FORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the present Chapter 24 of the Code of Ordinances,
City of Lubbock, Texas, BE and is hereby repealed.
SECTION 2. THAT the volume entitled Uniform Plumbing Code 1979
Edition as hereinafter specifically amended is adopted as the Plumbing Code of
the City of Lubbock, Texas, and a copy is attached hereto and incorporated
herein by reference as though set out completely in detail. A copy of said
Uniform Plumbing Code as hereinafter amended shall be filed with the City
Secretary and a copy maintained in the office of the Building Official of the
City of Lubbock, Texas, all such copies to be open to public inspection during
business hours of the offices where they are maintained with the following
amendments thereto.
SECTION 3. THAT the Plumbing Code hereby adopted shall be entitled
and numbered as Chapter 24 of the Code of Ordinances, City of Lubbock, Texas
and reference to its adoption shall be recorded in the Code of Ordinances.
SECTION 4. THAT Sec. 20.7 of the Uniform Plumbing Code 1979 Edition
be and is hereby amended by deleting from such section the 11SCHEDULE OF FEES"
as set forth in said section and substituting the following SCHEDULE OF PERMIT
FEES:

In all other respects said section shall remain as set forth in the
printed 1979 Edition of the Uniform Plumbing Code.
SECTION 5. THAT Sec. 20-14 of the Uniform Plumbing Code, 1979 Edition
be and is hereby amended to read as follows:
PLUMBING BOARD
(1) There is hereby created a Board to be known as the Plumbing Board
for the City of Lubbock, Texas.
(2) The Board shall consist of seven (7) members who shall serve without
compensation. The membership of said Board shall be as follows:
(a) City Building Official, or his authorized representative, who
shall be an ex-officio member of the Board without voting
privileges, and shall continue as such while holding this
office.
(b) City Senior Plumbing Inspector, who shall be an ex-officio
member of the Board without voting privileges, and shall continue
as such while holding this office.
(c) Either two licensed and active Master Plumbers or one licensed
and active Master Plumber and one licensed and active Journey-
man Plumber.
(d) Three members, other than Master or Journeyman Plumbers, (1)
a professional engineer registered in the State of Texas, (2)
a general building contractor, (3) a citizen of the City of
Lubbock, Texas, of voting age.
(3) THAT the members currently serving on the Plumbing Board as of the
passage of this Ordinance shall continue to serve in such capacity
until the expiration of the term of office to which they were ap-
pointed. The City Council shall thereafter appoint new members to
the Plumbing Board to hold office for a term of two (2) years.
(4) If for any reason, any of the members of the Board.shall be unable
to act, or shall resign from their respective positions or shall be
removed for any cause, then the City Council shall appoint a successo
or successors, who shall fill out the unexpired term or until respec-
tive successors shall be appointed.
(5) The City of Lubbock shall provide the Plumbing Board with proper
books of record, blank forms, stationery and supplies proper and
adequate for the conduct of its business.
(6) The Plumbing Board shall meet on a regular basis, said meetings to
be determined by the Board. The City Senior Plumbing Inspector or
his authorized representative shall act as Secretary to the Board
and shall keep a full record of the proceedings of such Plumbing
Board.
(7) It shall be the power and duty of the Plumbing Board to examine new
developments and changing conditions for additions, deletions,
amendments and changes to the "Plumbing Code" from time to time as
it may deem proper, and to submit to the City Council its written
suggestions for the improvement of the "Plumbing Code" of the City
of Lubbock.
(8) Appeals to the Plumbing Board may be made by the City Building
Official or any interested person and it is hereby made the power
and duty of the Plumbing Board when disputes arise between any
person, firm, association, partnership or corporation as to the
meaning of the "Plumbing Code", to interpret same; and when a majorit
of said Plumbing Board has interpreted the "Plumbing Code" as to its
meaning, said interpretation by said Plumbing Board shall be final
and binding on all persons, firms, associations, partnerships and
corporations.
(9) All of the members of the Plumbing Board shall be residents of the
City of Lubbock and actively engaged in their respective field of
experience.
(10) In cases where the Uniform Plumbing Code, 1979 Edition gives
discretionary power to the Building Official to permit deviation
from the provisions of said Code, only those deviations or changes
approved by the Building Official involving required material sub-
stitutions must also be approved by the Plumbing Board before same
can be performed in the City of Lubbock.
SECTION 6. THAT Section 20.15 of the Uniform Plumbing Code, 1979
Edition be and is hereby added to read as follows:
PLUMBER'S BOND
No person shall enter upon the installation, construction, recon-
struction or repair of any part of a plumbing system or public or private
sewer, including but not limited to piping, appliances, fixtures or
apparatus or any change thereof, nor shall any person undertake for any
other person the adjustment thereof until such person shall have executed
and delivered to the City of Lubbock a good and sufficient surety bond in
the sum of Three Thousand Dollars ($3,000.00) to be approved by the City
Attorney. Such surety bond shall be with a surety company duly authorized
to do business in the State conditioned for the faithful performance of
all such work entered upon or contracted for in strict accordance and

compliance with the terms, requirements and provisions of this chapter
and any other ordinance of the City of Lubbock. Such bond shall be
further conditioned that such person shall without additional cost to the
person for whom the work is done, remedy any defect therein due to faulty
workmanship or to noncompliance with this Code to the satisfaction of the
Plumbing Inspector within 72 hours after notice of such findings by him.
All sureties on any bond required by this Code shall be liable for breach
thereof to the owner of the property and any other person actually damaged
by such noncompliance or breach, not to exceed the face amount of such
bond. All bonds shall expire on December 31. No permit shall be granted
and no work shall be started on a contract under this Code until such
bond has been filed and approved by the City Attorney. Provided further,
that liability on such bond for the full amount thereof shall continue
until the surety has given the City written notice of cancellation or of
amount of claims of which it has been notified, in which event the con-
tracting plumber shall not pursue work further until a bond for the full
amount is filed.
SECTION 7. THAT Section 20.16 of the Uniform Plumbing Code, 1979 Edi-
tion be and is hereby added to read as follows:
GAS APPLIANCE, LAWN SPRINKLER AND WATER SOFTENER DEALER'S BOND
No person shall enter upon the installation or repair of any gas
appliance, lawn sprinkler, or water softener piping, fixtures or apparatus
or any change thereof, nor shall any person undertake for any other
person .the adjustment thereof, until such person shall have delivered to
the City of Lubbock a good and sufficient surety bond in the sum of Three

SECTION 8. Any person who violates any provision of this Ordinance
shall be deemed guilty of a misdemeanor, the punishment being as provided in
Sec. 1-5 of the Code of Ordinances of the City of Lubbock, Texas.
SECTION 9. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.

SECTION 10. THAT the City Secretary is hereby authorized to cause
ublication of the descriptive caption of this Ordinance as an alternative
ethod provided by law.

Sec. 24-1. Plumbing code adopted by reference.
The volume entitled Uniform Plumbing Code 1979
Edition, as hereinafter specifically amended is adopted as
the plumbing code of the City of Lubbock, Texas, and a copy
is attached hereto and incorporated herein by reference as
though set out completely in detaiL A copy of said Uniform
Plumbing Code as hereinafter amended shall be filed with
the city secretary and a copy maintained in the office of the
building official of the City of Lubbock, Texas, all such
copies to be open to public inspection during business hours
of the offices where they are maintained with the following
amendments thereto.

without first obtaining a permit to do such work from the Administra·
tive Authority.
(b) A seperate permit shall be obtained for each building or
structure.
(c) No person shall allow any other person to do or cause to
be done any work under a permit secured by a Permittee except
persons in his employ.
Work Not Requiring a Permit
20.5 No permit shall be required in the case of any repair work as
follows: The stopping of leaks in drains, soil, waste or vent pipe,
provided, hoWever, that should any trap, drainpipe, soil, waste or
vent pipe be or become defective and it becomes necessary to
remove and replace the same with new material in any part or parts,
the same shall be considered as such new work and a permit shall
be procured and inspection made as hereinbefore provided. No
permit shall be required for the cleaning or stoppages or the
repairing of leaks in pipes, valves, or fixtures, when such repairs do
not involve or require the replacement or rearrangement of valves,
pipes or fixtures.
Application for Permit
20.6 Any person legally entitled to apply for and receive a permit
shall make such application on forms provided for that purpose. He
shall give a description of the character of the work proposed to be
done, and the location, ownership, occupancy and use of the
premises in connection therewith. The Administrative Authority may
require plans, specifications or drawings and such other information
as he may deem necessary.
If the Administrative Authority determines that the plans, specifi·
cations. drawings, descriptions or information furnished by the
applicant is in compliance with this Code, he shall issue the permit
applied for upon payment of the required fee as hereinafter fixed.

and kind in connection therewith, together with such information,
pertinent thereto, as may be required.
Such applicant shall pay for each permit, at the time of iSS!Jance,'
a fee in accordance with the following schedule, and at the rate
provided for each classification shown herein.
Any person who stiall c.ommence any work for which a permit is
required by this Code without first having obtained a permit therefor
shall, if subsequently permitted to obtain a permit, pay double the
permit fee fixed by this section for such work, provided, however,
that this provision shall not apply to emergency work when it shall be
oroved to the satisfaction of the Administrative Authority that such
work was urgently necessary and that it was not practical to obtain a
Permit therefor before commencement of the work. In all such
cases. a oermit must be obtamed as soon as it is oractical to do so.
and if there be an unreasonable delav in obtainin~ such oermit. a

double fee as herein provided shall be charged.
For the purpose of this section. a sanitary plumbing outlet on or to
which a plumbing fixture or appliance may be set or attached shall
be construed to be a fixture. Fees for reconnection and retest of
plumbing systems in relocated buildings shall be based on the
number of plumbing fixtures, gas systems, water heaters, etc.,
involved.
When interceptor traps or mobilehome site traps are installed at
the same time as a building sewer on any lot, no sewer permit shall
be required for the connection of any such trap to an appropriate
inlet fitting provided in the building sewer by the permittee
constructing such sewer.
When a permit has been obtained to connect an existing building
or existing work to the public sewer or to connect to a new private
disposal facility, backfilling of private sewage disposal facilities
abandoned consequent to such connection is included in the
permit.

be made, in th~ interest of accuracy and clarity (the corrections will be
underscored).
At the 8:30 Work Session, Chairman of the Plumbing Board Ken
Wood appeared.to discuss with the Council the amendments to the
Uniform Plumbing Code,.l979 Edition, ~hich the Plumbing Board
voted to adopt back in Decembe:l:',' 1979• The following ch~nges
are recommended E1:_ the. City Council:
3 The Plumbing Boardrecommends that the Building
Officia1 have diScretionary authority except witli
respect to material substitutions, in that. it would
·be too cumbersome to submit all of these changes 'i:()
the Plumbing Board for approval, .and such 'discretionary
authority would be advanrageous to the respective • '
