Adding Penalty Clause To Regulation Of Fireworks - 08/14/1980SMT:bs AN ORDINANCE AMENDING ORDINANCE NO. 7510, CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, ADDING A PENALTY CLAUSE TO REGULATION OF FIREWORKS; PROVIDING FOR PUBLICATION, AND PROVIDING A SAVINGS CLAUSE. ! l WHEREAS, Chapter 19, Sections 19-3 through 19-6 of the Code of Ordinances! of the City of Lubbock provides for regulation of fireworks with seizure as the sole remedy for violation; and I WHEREAS, Chapter 1, Section 5 of the Code of Ordinances of the City of Lubbock provides for a fine of not more than $200.00 for the violation of any ordinance; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I I i I i SECTION 1. THAT Chapter 19 of the Code of Ordinances BE and the same f I is hereby amended by adding the following section: r "Sec. 19-6a. Penalty. Any person, firm or corporation violating any provision of Sections 19-3 through 19-6 shall upon conviction thereof be fined in any sum not to exceed two hundred dollars ($200.00)." ll SECTION 2. THAT should any section, paragraph, sentence, clause, il phrase, or word of this Ordinance be declared unconstitutional or invalid for !1 any reason, the remainder of this Ordinance shall not be affected thereby. \I ll SECTION 3. THAT the City Secretary is hereby authorized to cause I! publication of the descriptive caption of this Ordinance as an alternative : method provided by law. t·i AND IT IS SO'ORDERED.
