ORDINANCE NO. 9126
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP
OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2607; A
ZONING CHANGE FROM R-1, R-2, A-1, AND A-2 TO A-2 ZONING ON A TRACT OUT OF
SMITHLAWN ADDITION, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS
CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient and
in the interest of the public health, safety and general welfare to make
those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 29-29 of the Code of Ordi-
nances, City of Lubbock, Texas, as well as notices provided by Article
lOllf, Vernon 1s Annotated Civil Statutes, and notice was duly published in
the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date
of the public hearing before the City Council on such proposed amendment,
and the public hearing according to said notice was duly held in the City
Council Chamber of the Municipal Building, Lubbock, Texas, at which time
persons appeared in support of the proposal; and, after said hearing, it was
by the City Council determined that it would b~ in the public interest, due
to changed conditions, that the Zoning Ordinance and the Zoning Map be
amended in the manner hereinafter set forth in the body of this Ordinance
and this Ordinance having been introduced prior to first reading hereof; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2607
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
A change of zoning from R-1, R-2, A-1, and A-2 to A-2 zoning district,
under provisions of Section 29-29 of the Code of Ordinances of the
City of Lubbock, on a tract out of Smithlawn Addition, City of
Lubbock, Lubbock County, Texas, bordered by 76th Street, Loop 289,
I-27 and Avenue 0.
METES ANO BOUNDS DESCRIPTION of Blocks 8, 9, 10, 11, that portion of
Blocks 12, 13, and the North half of Block 14 lying East of the Inter-
state 27 right-of-way, and a portion of their included rights-of-way,
Smithlawn Addition to the City of Lubbock, Lubbock County, Texas, be-
ing further described as follows:
BEGINNING at the original Northeast corner of Block 8, Smithlawn Addi-
tion to the City of Lubbock, Lubbock County, Texas;
THENCE South a distance of 444.85 feet;
THENCE S. 41°47' W. a distance of 33.62 feet;
THENCE West a distance of 1131.20 feet;
THENCE Southerly around a curve to the left, said curve having a ra-
dius of 50.00 feet, a central angle of 60°, tangent lengths of 28.87
feet, a chord distance of 50.00 feet, and a chord bearing of South;
THENCE East a distance of 213.60 feet;
THENCE South a distance of 130.00 feet;
THENCE West a distance of 342.00 feet to a point of curvature;
THENCE Northwesterly around a curve to the right, said curve having a
radius of 10.00 feet, a central angle of 90°, tangent lengths of 10.00
feet, and a chord distance of 14.14 feet;
THENCE North a distance of 120.00 feet;
THENCE 05°55'44" E. a distance of 50.27 feet;
THENCE Northeasterly around a curve to the right, said curve having a
radius of 1076.35 feet, a central angle of 14°48 1 15 11 , a chord distance
of 277.34 feet, and a chord bearing of N. 18°20 1 5411 E.;
THENCE N. 56°08 13811 E. a distance of 21.08 feet;
THENCE N. 54°11 153 11 E. a distance of 60.06 feet to a point of curva-
ture;
THENCE Northeasterly around a curve to the left, said curve having a
radius of 326.99 feet; a central angle of 35°23 13711 , tangent lengths
of 104.34 feet, and a chord distance of 198.80 feet;
THENCE East a distance of 1015.03 feet to the POINT OF BEGINNING.
CONTAINING: 13.893 acres.
METES AND BOUNDS DESCRIPTION of the North half of Block 15, Smithlawn
Addition to the City of Lubbock, Lubbock County, Texas, being further
described as follows:
BEGINNING at the original Northeast corner of Lot 1, Block 15, Smith-
lawn Addition to the City of Lubbock, Lubbock County, Texas;

THENCE South a distance of 130.00 feet;
THENCE West a distance of 600.00 feet;
THENCE North a distance of 130.00 feet;
THENCE East a distance of 600.00 feet to the POINT OF BEGINNING.
CONTAINING: 1.791 acres
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi-
nance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
