AN ORDINANCE AMENDING SECTION 16-3 OF THE LUBBOCK CITY CODE OF ORDINANCES
SO AS TO CORRECT A REFERENCE THEREIN FROM 16-6 OF SAID CODE TO THE CORRECT
REFERENCE OF 16-13 OF SAID CODE; AMENDING SECTION 16-4 OF THE LUBBOCK CITY
CODE AS HEREINAFTER SET FORTH WITH RESPECT TO REGULATIONS ABOUT·DIRT, DEBRIS,
OR OTHER SOLID MATERIALS IN LAKE AREAS; PROVIDING FOR A PENALTY; AND PROVIDING
FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock finds that it is in the
public interest to make revisions in the lake area provisions of the Lubbock
City Code; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 16-3 of the Lubbock City Code of Ordinances
be and the same is hereby amended by changing the reference in said section of
the code from Section 16-6 of the Lubbock City Code to the correct reference
of 16-13 and said reference shall hereinafter be Section 16-13 of the Lubbock
City Code, this being the only change in said Section by this amendment and
all other provisions of said Section 16-3 shall remain the same.
SECTION 2. Section 16-4 of the Lubbock City Code of Ordinances is
hereby amended in its entirety to read as follows:
"Sec. 16-4. Use of fill prohibited.
It shall be unlawful for any person to spread, or use for
filling purposes or cover over, or otherwise use or permit to be
used upon any .land within a lake area any dirt, debris or other
solid materials which have been transported or moved in any
manner to a lake area from outside the lake area, and whoever
violates any part of this provision shall be guilty of maintaining
a nuisance; provided, however, that this section shall not apply
when a cut and fill plan has been duly approved by the City
Engineer and the Planning and Zoning Commission which allows
the use of solid materials from outside the lake area to be
exchanged for solid materials that have been removed from the
lake area and when such cut and fill plan is not designed or
calculated to decrease the water-holding capacity of the lake
area involved. Any appeal of a decision of the City Engineer
and Planning and Zoning Commission shall be made to the City
Council."
SECTION 3. Violation of any provisions of this Ordinance shall be
deemed a misdemeanor punishable by a fine not to exceed two hundred dollars
($200.00) as provided in Section 1-5 of the Lubbock.City Code.

SECTION 4. The City Secretary is hereby authorized and directed as an
alternate method of publication as provided by law to publish the descriptive
caption and penalty provisions of this Ordinance once a week for two consecutive
weeks.
