HomeMy WebLinkAboutOrdinance - 8052-1980 - ORDINANCE AMENDING ZONING ORDINANCE 7084 OF THE CITY OF LUBBOCK - 05/22/1980c AN ORDINANCE AMENDING ZONING ORDINANCE 7084 OF THE CITY OF LUBBOCK; REFERRING TO RESIDENTIAL FRONT LOT LINES, PROVIDING A PENALTY, PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in the Zoning Ordinance as hereinafter made has been duly presented to the Planning and Zoning Commission for its recom- mendation which was received by the City Council and, the City Council finds after public hearing that it is in the best interest of the public health, morals and general welfare to make those proposed changes; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance have been fully complied with; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. follows, to-wit: THAT ORDINANCE 7084 BE and the same is hereby amended as 2.49a FRONT LOT LINE, RESIDENTIAL: The front of a lot shall be considered to be that side of the lot, which fronts on a street. In the case of a corner lot, the narrowest side fronting on the street shall be considered to be the front of the lot. In case the corner lot has equal frontage on two or more streets, the lot shall be considered to front on that street which the greatest number of lots abut. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-5 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause. phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. AMEND ORDINANCE 7084 PRESENT FRONT LOT LINE, RESIDENTIAL: All lot lines contlquous with a street, and which do not terminate or intersect with an alley shall be front lot lines. If all lot lines contiguous with a street terminate or intersect with an alley, the front lot· line shall be the shortest lot line contiguous with a street. If all lot lines contiguous with a street terminate or intersect with an alley, and are of ide.ntical length, the front lot 1 ine shall be the lot line contiguous with the narrowest street. If all lot lines contiguous with a street terminate or intersect with an alley,·are of identical length, and are contiguous with streets of ideritical width,. the front lot line shall be whichever lot line •cpntiguous with a street is designated by the property owner or platting proponent at the time of platting. Every lot must have at least one front lot line.
