ORDINANCE NO. 9106
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP
OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2152-E; A
ZONING CHANGE FROM C-3 TO C-4 ZONING, LIMITED TO CERTAIN LISTED USES, ON
TRACTS OUT OF SECTION 44, BLOCK A-K, AND LOT 2, CROSSROADS ADDITION,
LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAV-
INGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient and
in the interest of the public health, safety and general welfare to make
those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 29-29 of the Code of Ordi-
nances, City of Lubbock, Texas, as well as notices provided by Article
lOllf, Vernon 1s Annotated Civil Statutes, and notice was duly published in
the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date
of the public hearing before the City Council on such proposed amendment,
and the public hearing according to said notice was duly held in the City
Council Chamber of the Municipal Building, Lubbock, Texas, at which time
persons appeared in support of the proposal; and, after said hearing, it was
by the City Council determined that it would be in the public interest, due
to changed conditions, that the Zoning Ordinance and the Zoning Map be
amended in the manner hereinafter set forth in the body of this Ordinance
and this Ordinance having been introduced prior to first reading hereof; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2152-E
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
A change of zoning from C-3 to C-4 zoning district, limited to certain
listed uses, under provisions of Section 29-29 of the Code of Ordi-
nances of the City of Lubbock, on tracts out of Section 44, Block A-K,
and on Lot 2, Crossroads Addition, City of Lubbock, Lubbock County,
Texas, located at 2022 West Loop 289, subject to conditions and being
further described as follows:
Lot 2, Crossroads Addition to the City of Lubbock, Lubbock County,
Texas consisting of 11.3765 acres; plus
METES ANO BOUNDS DESCRIPTION of a 2.117 acre tract located in the
Northeast Quarter of Section 44, Block A-K, Lubbock County, Texas;
BEGINNING at a 1/211 iron rod (set) which bears South a distance of
359.77 feet and East a distance 346.33 feet from the Northwest corner
of the Northeast Quarter of Section 44, Block A-K;
THENCE North a distance of 294.34 feet to a 1/211 iron rod (set) for a
corner of this tract;
THENCE Southeasterly, around a curve to the right, said curve having a
radius of 477.00 feet, a central angle of 59°33'2811 , a chord distance
of 473.81 feet, and tangent lengths of 272.95 feet to a 1/211 iron rod
(found) at a point of tangency;
THENCE S. 29°46 13011 E. a distance of 62.50 feet to a 1/211 iron rod
(set) for a corner of this tract;
THENCE West a distance of 439.50 feet to the POINT OF BEGINNING.
CONTAINING: 1.133 acres.
METES AND BOUNDS DESCRIPTION of a 1.769 acre tract of land located in
the Northeast Quarter of Section 44, Block A-K, Lubbock County, Texas;
BEGINNING at a set 1/211 iron rod which bears South a distance of
965.27 feet and East a distance of 821.00 feet from the Northwest cor-
ner of the Northeast Quarter of Section 44, Block A-K, same point be-
ing in the North right-of-way line of 21st Street.
THENCE N. 26°33'5411 W., a distance of 11.18 feet to a set 1/211 iron
rod;
THENCE North, a distance of 342.03 feet to a set 1/211 iron rod;
THENCE N. 60°13 1 3011 E., a distance of 99.67 feet to a set 1/211 iron
rod located in the West right-of-way line of Loop 289;
THENCE S. 29°46 13011 E., along the West line of said Loop 289, a dis-
tance of 408.26 feet to a point of curvature;
THENCE Southerly, around a curve to the right, said curve having a ra-
dius of 15.00, a central angle of 90°, tangent lengths of 15.00 feet,
a chord distance of 21.21 feet to a found 1/2" iron rod at a point of
compound curvature in the North right-of-way line of 21st Street;
THENCE Southwesterly, around a curve to the right, said curve having a
radius of 202.11 feet, a central angle of 29°46 130 11 , tangent lengths

of 53.73 feet, a chord distance of 103.85 feet to a found 1/211 iron
rod;
THENCE West along the North line of 21st Street, a distance of 178.31
feet to the POINT OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That the zoning shall be C-4 limited to the following uses on
lot 2:
1. All unconditionally permitted C-3 uses;
2. Auto body shop;
3. Auto brake shop;
4. Auto glass shop;
5. Auto seat cover and upholstery;
6. Auto transmission shop;
7. Auto and recreational vehicle sales and service, including
used car sales and service as an incidental use;
8. Garage, public repair;
9. Gasoline service station; and
10. Muffler shop.
b. That the zoning shall be C-4 limited to the following uses on
the unplatted out-parcels described in the metes and bounds set
out above:
1. All unconditionally permitted C-3 uses;
2. Auto and recreational vehicle sales and service, including
used car sales and service as an incidental use.
c. That the proposed automobile dealership must be in place before
the other permitted C-4 uses are developed.
d. That any new structure on the development tract or any alter-
ation of the existing mall facade on the North or East for over-
head doors shall be subject to elevation and materials review by
the Planning and Zoning Commission prior to the issuance of a
building permit.

SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi-
nance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative
method provided by law.
