HomeMy WebLinkAboutOrdinance - 9102-1987 - Adopting Budget Fiscal Year 1987-88 Revised Budget Figures - 08/13/1987JCR:da First Reading August 13, 1987 Agenda Item #14 Second Reading AAUQU§ t 27, 1987 genua I tern #20 ORDINANCE NO. 9102 AN ORDINANCE APPROVING AND ADOPTING A BUDGET FOR FISCAL YEAR 1987-88; APPROVING REVISED BUDGET FIGURES FOR THE FISCAL 1986-87; PROVIDING FOR NEC- ESSARY TRANSFERS OF FUNDS BETWEEN ACCOUNTS AND DEPARTMENTS, IF REQUIRED; PROVIDING INCREASED REVENUES AS REFLECTED IN SAID BUDGET BY REVISING MINIMUM WATER RATES AS CONTAINED IN SECTIONS 28-52 AND 28-53 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK; PROVIDING INCREASED REVENUES AS REFLECTED IN SAID BUDGET BY REVISING SECTION 23-66(A)(l) AND (2) OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK INCREASING CERTAIN RATES FOR GARBAGE AND TRASH COLLECTION AS SET FORTH IN SAID SECTION; AND APPROPRIATING FUNDS FOR THE 1987-88 FISCAL YEAR BUDGET OF THE CITY OF LUBBOCK. WHEREAS, the City Manager has prepared certain figures as a 1987-88 fiscal year budget and has submitted the same to the City Council; and WHEREAS, the City Manager, on July 17, 1987, filed such proposed bud- get with the City Secretary for the fiscal year beginning October 1, 1987; and WHEREAS, the City Secretary did post notice that such proposed budget had been filed and a public hearing called thereon by the City Council in City Hall; and WHEREAS, the Council determined such proposed budget for fiscal year 1987-88 to be appropriate and correct in all respects and that all require- ments of the law have been satisfied; and WHEREAS, said budget is predicated and prepared based upon certain increases in minimum water rates and increases in certain garbage and trash collection rates; and WHEREAS, it is necessary to amend the Code of Ordinances of the City of Lubbock to reflect said increased in rates and charges in order to implement the budget for Fiscal Year 1986-87 as herein adopted; NOW THEREFORE: I. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the budget proposed by the City Manager for the fis- cal year October 1, 1987, through September 30, 1988, BE and the same IS hereby approved and adopted. SECTION 2. THAT the figures prepared and submitted by the City Man- ager for the 1987-88 fiscal year budget BE and the same ARE hereby approved in all things. SECTION 3. THAT any necessary transfer of funds between accounts, departments or programs by the City Manager for City purposes or as a result.of unusual and unforeseen conditions during the administration of the 1987-88 fiscal year budget BE and ARE hereby authorized and approved. SECTION 4. THAT amounts set out under the headings 111986-87 Revised,11 BE and ARE hereby authorized and approved. SECTION 5. THAT the several amounts, as set forth in the proposed 1987-88 fiscal year budget BE and ARE hereby appropriated to the objects and purposes therein named, subject to notification in accordance with Section 3 hereof if necessary. SECTION 6. THAT a copy of the 1987-88 fiscal year budget shall be filed with appropriate officials as required by law. AND IT IS SO ORDERED. II. BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 28-52 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Sec. 28-52. Minimum rate. (a) The minimum rate for water, which shall be charged all consumers, except as otherwise provided, shall be six dollars and twenty-one cents ($6.21) per month. (b) In calculating the minimum rate to be charged townhouses or condominiums, the minimum rate of six dollars and twenty-one cents ($6.21) per month shall be multiplied by the total number of units in such building or complex subject to single building. SECTION 2. THAT Section 28-53 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Sec. 28-53. Rates generally. (a) The city, through its water department, shall charge and collect, and every consumer shall pay, for water furnished by the city to the consumer, the amount calculated by application of the following rates to meter readings for all billing cycles beginning on or after October 1, 1987. First 1,000 gallons (minimum) .................... $6.21 Next 49,000 gallons (per thousand) .•••........... $1.13 Next 200,000 gallons (per thousand) ........•..•.. $ .97 All over 250,000 gallons (per thousand) ....•..•.. $ .91 (b) For townhouse or condominium complex served by a single connection and meter, the total charges shall be calculated on the basis of determining the average water usage for each unit served and - 2 - / applying the minimums and rates herein provided for single consumers and multiplying such average per unit cost by the number of units served. III. BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 23-66 of the Code of Ordinances of the City of Lubbock BE and is hereby amended by amending the language of Sec. 23- 66(a), subparagraphs (1) and (2) to read as follows: (1) Residential: (One unit) --Six dollars and fifty cents ($6.50) per month. (2) Small comercial, churches, day nurseries, private schools, professional offices, home beauty shops, other customary home occupations, nursing homes, orphan, maternity and geriatric homes, lodges, sororities and fraternities generating less than 20 cubic feet per pickup --$6.50 per month. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
