SPEED ZONE FOR SOUTH BOUND TRAFFIC TO A NEW 45 M.P.H. SPEED ZONE OF 45 M.P.H. ON QUAKER AVENUE FOR SUCH SOUTH BOUND TRAFFIC BEGINNING AT 4TH STREET AND EXTENDING SOUTH TO 19TH STREET AND LEAVING THE EXISTING 45 M.P.H. SPEED ZONE THE SAME FOR NORTH BOUND TRAFFIC ON QUAKER BEGINNING AT 19TH STREET AND EXTENDING NORTH TO 4TH STREET TO THE END THAT AFTER PASSAGE OF THIS ORDINANCE THERE SHALL BE A 45 M.P.H. SPEED ZONE IN EFFECT ON BOTH SIDES OF QUAKER AVENUE FROM 4TH STREET TO 19TH STREET; AUTHORIZING THE PLACING OF SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the governing body of the City of Lubbock, as authorized by Article 6701d, Section 169(b) Vernon's Texas Civil Statutes, finds that certain prima facie speed limits on certain streets are different from what is reasonable or safe and should be altered as hereinafter set forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. Subsections 4 and 5 of Section 1 of Ordinance No. 6115 of the City of Lubbock are hereby changed and amended or left to remain the same so as to change the existing 40 M.P.H. speed zone for South bound traffic to a new 45 M.P.H. speed zone of 45 M.P.H. on Quaker Avenue for such South bound traffic beginning at 4th Street and extending South to 1 19th Street and leaving the existing 45 M.P.H. speed zone the same for North bound traffic on Quaker beginning at 19th Street and extending North to 4th Street to the end that after passage of this Ordinance there shall be a 45 M.P.H. speed zone in effect on both sides of Quaker Avenue from 4th Street to 19th Street. I SECTION 2. THAT the City Manager is authorized and directed to cause ,1 1 ·1 the placing of signs so as to clearly define the limits of the prima facie · areas set out in this Ordinance. SECTION 3. THAT any person, firm, or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED DOLLARS ($200.00). SECTION 4. THAT the City Secretary is hereby authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty as an alternative method of publication provided by law. SECTION 7. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. 1 SECTION 8. THAT this Ordinance shall become effective ten (10) days after the date of its last publication. AND IT IS SO ORDERED.
