HomeMy WebLinkAboutOrdinance - 6654-1973 - Zoning Change-Case 1895, Tract Out Of Sec. 10, Blk E-2 - 05/23/1973 (2):pr ORDINANCE NO. 6654 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1895: CHANGE A TRACT OF LAND OUT OF SECT! 10, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM AN 11R-lu TO A nC-2" ZONING DISTRICT; SUBJECT'TO CONDITIONS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to fE Planning and Zoning Commission for its recommendatio , which was received by the City Council and after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully Co)mplied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal mc;;;z.e tha fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was dul held in the City Council Room on the second floor of the City Hall, Lubbock, Texa 1 at which time persons appeared in support of the proposal; and., after said hearing l it was by the City Council determined that it wouldbe in the public interest, due to changed c6 nditions., that the Zoning Ordinance and the Zoning Map be amended in the manne~ hereinafter set forth in the body of this Ordinance and this Ordinance having beetn introduced prior to first reading hereof; NOW THEREFORE: I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 1895: Change a tract of land out of Section 10, Block E-2, City of Lubbock, Lubbock County, Texas, from an 11R-l'1 to a ''C-2" Zoning District. Property is further described by metes and bounds to-wit: BEGINNING at a point which is the Southeast corner of the Northeast 1/4 of Section 10, Block E-2, Lubbock County, Texas; THENCE S 89 ° 571 30 11 W, a distance of 88,791 to a point in the East line of Quaker Avenue; THENCE N 27 ° 031 W, with the East line of Quaker Avenue, a distance of 865. 54 feet; THENCE N 62 ° 57' E, a distance of 15. 00 feet; ~~ ~ II KJ:pr THENCE Northerly_. with a curvEi .:W the right_. said curve having a radius of 215. 00 feet, a distance of 500. 581 to a point in the south R-O-W line of Loop 289; THENCE S 72° 03' E, with the south R-O-W line of Loop 289, a distance of 224. 831 to a point in the east line of Section 10, Block E-2; THENCE S 0 O 031 E, with the East line of said Section 10 a distance of 1017 .18 feet to the PLACE OF BEGINNING, con taining 8. 278 acres more or less. SUBiJECT TO CONDITIONS: 1. That development shall be in accordance with the site plan approved by the City Council on May 23, 1973., and made a part hereof. SECTION 2, THAT from and after passage and effective date of this Ordinance, said lots., tracts and parcels of land described in Section 1 hereof shal be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT should any section. paragraph., sentence, clause, phras or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainde r of this Ordinance shall not be affected thereby. I SECTION 4. THAT the City Secretary is hereby authorized to cause publica tion of the I descriptive caption of this Ordinance· as an alte rnative method provided by law.
