Zone Change - 06/25/1987I LJM:js First Reading June 25, 1987 Agenda Item #dO Second Reading July 9, 1987 Agenda Item #12 ORDINANCE NO. 9088 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1805-C; A ZONING CHANGE FROM R-2 TO GO ZONING ON A TRACT OUT OF SECTION 15, BLOCK E-2, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVID- ING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the l City Council finds that due to changed conditions, it would be expedient and I in the interest of the public health, safety and general welfare to make , those proposed changes in zoning; and II I I WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordi- nances, City of Lubbock, Texas, as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, and notice was duly published in ! 1 . the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, I . and the public hearing according to said notice was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was 'I by the City Council determined that it would be in the public interest, due 1 to changed conditions, that the Zoning Ordinance and the Zoning Map be 1, amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1805-C SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: A change of zoning from R-2 to GO zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract of land out of Section 15, Block E-2, City of Lubbock, Lubbock County, Texas, located at the Southwest corner of 85th Street and Quaker Avenue and being further described as follows: METES AND BOUNDS DESCRIPTION of a tract located in Section 15, Block E-2, Lubbock County, Texas, being shown as Tract 11A11 , on the prelimi- nary plat of Cobblestone, dated May 13, 1987, being further described as follows: i 1I I· 1I ,,' i I I BEGINNING at a point which bears South an approximate distance of 1448.00 feet and West a distance of 55.00 feet from the Northeast cor- ner of Section 15, Block E-2, Lubbock County, Texas; THENCE South an approximate distance of 135.00 feet; THENCE West an approximate distance of 105.00 feet; THENCE North an approximate distance of 150.00 feet; THENCE East an approximate distance of 90.00 feet to a point of curva- ture; THENCE Southeasterly around a curve to the right said curve having a radius of 15.00 feet, tangent lengths of 15.00 feet, a central angel of 90°, and a chord distance of 21.21 feet to the POINT OF BEGINNING. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any rea- son, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
